Title
Approving and Adopting the Toledo Lucas County Port Authority's Amended Operating Plan and Budget relating to On Street Parking Hours, Rates and Fees; authorizing and directing the Commissioner of Transportation to make amendments to the Rules of the Commissioner to effectuate the Amended Operating Plan and Budget; authorizing the mayor to execute necessary amendments to the area of the On-Street Parking Service Area; and declaring an emergency.

SUMMARY & BACKGROUND:
In 2011 the City of Toledo and the Toledo Lucas County Port Authority ("Port Authority") entered into a Parking Facilities, Franchise and Enforcement Services Agreement (the "Agreement")(attached hereto as Exhibit A) that, among other things provided the Port Authority with the franchise for paid, on street parking in a Service Area in downtown Toledo. Under the terms of the Agreement, parking hours, rates and fees could generally only be changed with Council approval. In the event changes were necessary, the agreement provided for submission of a request by the Port Authority to Council accompanied by an operating plan and budget. Moreover, the Agreement sets forth the franchise Service Area and provides for amendment of that Service Area as may be required.
Summary
NOW, THEREFORE, Be it ordained by the Council of the City of Toledo:
SECTION 1. That the mayor is authorized to implement the modifications to the agreement attached as Exhibit B which are approved and adopted.
Amending Section 6.01 of the Agreement to Implement All Day Paid Meter Parking, and Expand the Hours of On-Street Parking Operations.
Amending Section 7.02 of the Agreement to modify the Service Area to include the areas indicated in the map in Exhibit C.
Amending Section 3.02 of the Agreement to modify the Annual Franchise Fee to be calculated by allowing the Port Authority to separate and retain all revenue associated with parking garages and the direct all net (revenue minus expenses) parking revenues from on-street parking to the City of Toledo.
SECTION 2. That the Commissioner of Transportation is authorized and directed to make such changes to the Administrative Rules of the Commissioner as may be required to effectuate the amendments to hours, rates and fees as contemplated in Section 1.
SECTION 3. That this Ordinance is declared to be an emergency measure and shall take effect and be in force immediately from and after its passage. The reason for the emergency lies in the fact that this Ordinance is necessary for the immediate preservation of the public peace, health, safety and property and for the further reason that this Ordinance must be immediately effective in order to ensure uninterrupted and effective regulation of on street parking.
