Title
Establishing a Community Entertainment District pursuant to the provisions of Ohio Revised Code Section 4301.80 in the Lowertown Area; making certain findings related thereto; and declaring an emergency.

SUMMARY & BACKGROUND:
The Ohio Revised Code contains a provision for the establishment of a Community Entertainment District for areas containing uses such as restaurants, nightclubs, retail sales establishments, sports facilities, hotels, museums, and similar uses. Will Lucas of TolHouse Summit, LLC forwarded an application to the Mayor requesting the establishment of an entertainment district. The Mayor has reviewed this application and has recommended approval by Council. Council has scheduled a public hearing on Wednesday, July 14 at 10:45 AM to hear testimony regarding the proposed Entertainment District if it will increase entertainment options, improve pedestrian experience, and encourage development in this Lowertown Area. This Ordinance establishes a Community Entertainment District for the area covered by the application submitted.
Summary
NOW, THEREFORE, Be it ordained by the Council of the City of Toledo:
SECTION 1. That Council hereby finds, does and will substantially contribute to entertainment, retail, educational, sporting, cultural and arts opportunities for the community.
SECTION 2. That a Community Entertainment District be and is hereby established by Council pursuant to the provisions of Ohio Revised Code Section 4301.80 for the area contained within the legal description contained in Exhibit A of this Ordinance, which is fully incorporated herein.
SECTION 3. That this Ordinance hereby is declared to be an emergency measure and shall be in force and effect from and after its passage. The reason for the emergency lies in the fact that same is necessary for the immediate preservation of the public peace, health, safety and property, and for the further reason that the establishment of a Community Entertainment District in the Lowertown Area will promote economic development and tourism in the City of Toledo.
