SUMMARY & BACKGROUND:

Ordinance 154-19 passed by Council and signed by the Mayor was an estimate of what was anticipated to be received from the Department of Housing and Urban Development (HUD) for the Community Development Block Grant (CDBG).  The City of Toledo was informed by HUD it will receive $7,423,463 for Fiscal Year 2019. 

 

The financial impact of this Ordinance is the receipt of $7,423,463; $711,899 more than what was anticipated from HUD to the City of Toledo for the administration of the CDBG Program.  No new programs or activities are added to those approved by City Council and the Mayor under Ordinance 154-19.

 

Summary

NOW, THEREFORE, Be it ordained by the Council of the City of Toledo:

 

SECTION 1.  That Ordinance 154-19 is repealed in its entirety.

 

                     SECTION 2.  That the mayor is authorized to submit the 2019-2020 One-Year Action Plan, accept the 2019 (45th) Program Year CDBG allocation from HUD in the amount of $7,423,463, and deposit the amount received from HUD into Account Code 2015-16100-407400-5G45000STDREV (Community Development Block Grant Fund) for the purpose of funding the CDBG Program.

 

                     SECTION 3.                       That the appropriation in the amount of $7,423,463 is authorized from the unappropriated grant proceeds of the Community Development Block Grant Fund into various accounts; and further authorizing the expenditure of same pursuant to the attached Schedule A.

 

                     SECTION 4.                     That a portion of the CDBG carryover balance in the amount of $1,035,000 is authorized for expenditure in the Community Development Block Grant Fund from all years prior to program year 2019 (45th) pursuant to the attached Schedule B.

 

                     SECTION 5.  That the Mayor and the Director of Neighborhood and Business Development are authorized to enter into any necessary agreements for the purposes listed herein subject to the terms and conditions deemed proper and requisite according to the Director of Law, not to exceed the amount of $7,423,463 for the 2019 (45th) Year CDBG and not to exceed $1,035,000 from the CDBG carryover balance from all years prior to program year 2019 (45th).

 

                     SECTION 6.  That the Finance Director is authorized to issue his warrant or warrants in an amount not to exceed $7,423,463 from the Community Development Block Grant Fund in payment of all obligations authorized under the 2019 (45th) Year CDBG allocation and not to exceed $1,035,000 from the CDBG carryover balance from all years prior to program year 2019 (45th) upon presentation of properly approved documentation.

 

                     SECTION 7.                       That this Ordinance is declared to be an emergency measure and shall take effect and be in force from and after its passage.  The reason for the emergency lies in the fact that same is necessary for the immediate preservation of the public peace, health, safety and property, and for the further reason that same must be immediately effective in order to permit the City to submit the One-Year Action Plan, qualify under the regulations of the Community Development Block Grant Entitlement Program, and to receive the money necessary to carry out its planned community development activities for the 2019 45th) year beginning July 1, 2019 and ending June 30, 2020.
