Title
Waiving the competitive bidding requirements of TMC Chapter 187; authorizing the Mayor to enter into an agreement with Creadio for the continued implementation of the Lead Poisoning Prevention Campaign; and declaring an emergency.

SUMMARY & BACKGROUND:
This ordinance requests authorization to waive the competitive procurement requirements of TMC Chapter 187 in order to continue the implementation of the Lead Poisoning Prevention Campaign by providing supplementary funds to our current marketing expert, Creadio, as a direct vendor for the City of Toledo.
Creadio has been working with the City of Toledo, Department of Neighborhoods in 2020-2021 to develop and implement the Lead Poisoning Prevention Campaign. The previous competitive bidding process and funds distribution was provided by CareNet, and Creadio completed the plan for this campaign in 2020. In order to continue implementing the plan, additional dollars have already been allocated to support marketing and education efforts for the Lead Poisoning Prevention Campaign and the Lead Safe Ordinance. Creadio is the expert at developing this content and engaging various media outlets to implement this approved plan. Continuing to work with Creadio rather than engaging a new vendor is essential for timely deployment of funds and successful implementation of the Lead Poisoning Prevention Campaign and the Lead Safe Ordinance.
The estimated budget and plan for these funds are attached as EXHIBIT A.
For these reasons, the regular competitive bid process will not result in any further cost savings and would cost additional staff time and implementation delays.
Summary
NOW, THEREFORE, Be it ordained by the Council of the City of Toledo:
SECTION 1. That this Council finds and determines it is in the best interest of the City for the mayor to enter into contract with Creadio for no more than $160,000, of which $80,000 will be drawn from account code 1001/16200/537400/5632005STDSTD and up to $80,000 may be drawn from account code 2016/16200/5GL7010STDLBP.
SECTION 2. That this Council finds and determines it is in the best interest of the City to waive the competitive bidding requirements of TMC Chapter 187 for the reason that the City is already working with this vendor and these funds are supplementary to the current approved marketing and education campaign, and additional delays would hinder the success of the lead safe program and put at risk many Toledo children for whom time is of the essence to prevent additional lead poisoning.
SECTION 3. That this Ordinance is declared to be an emergency and shall be in force and effect from and after its passage. The reason for the emergency lies in the fact that this ordinance is necessary for the immediate preservation of the public peace, health, safety and property of the city and for the further reason that this ordinance must be immediately effective in order to successfully implement the lead safe program and related ordinance.
