SUMMARY AND BACKGROUND
On November 19, 2023, the cart barn at Detwiler Golf Course was broken into and fifteen (15) golf carts were stolen. All but nine (9) golf carts were recovered. A proposed agreement has been reached in the amount of $56,300 to settle the claim of the owner/lessor Lake Erie Golf Cars for the replacement of the nine (9) missing golf carts, without constituting an admission of liability.

Summary
NOW, THEREFORE, Be it ordained by the Council of the City of Toledo:

SECTION 1. That the expenditure of $56,300 is authorized from the Risk Management Fund Account Code 7095-12000-1157001STDSTD for the settlement of Lake Erie Golf Cars claim against the City of Toledo.

SECTION 2. That payment of these claims is contingent upon the execution of the proper releases by the claimant.

SECTION 3. That the Director of Finance is authorized to draw a warrant or warrants to Lake Erie Golf Cars in the sum of $56,300 against the above Account Code upon presentation of the proper voucher or vouchers.

SECTION 4. That this Ordinance, being an emergency measure, shall take effect and be in force after its passage. The reason for the emergency lies in the fact that this Ordinance is necessary for the immediate preservation of the public peace, health, safety and property and for the further reason that this Ordinance must be immediately effective in order to implement the settlement in accordance with the conditional agreement of the Administration.
