Title

Authorizing the Mayor to enter into a three-year contract with Fire Recovery USA for state and municipal fire code fee processing and collection services; authorizing the acceptance and deposit of revenues into the General Fund; waiving competitive bidding under TMC Chapter 187; and declaring an emergency.

SUMMARY & BACKGROUND:

The Toledo Fire and Rescue Department (TFRD) provides a variety of inspection and permit services pursuant to applicable state and municipal fire codes and accordingly seeks to contract with Fire Recovery USA for related fee collection services for a three-year term. Said contracted service employs best industry fee processing and collection standards that ensure fair and equitable practices whilst yielding higher revenues over current collection strategies.

 

Summary

NOW, THEREFORE, Be it ordained by the Council of the City of Toledo: 

 

SECTION 1. That the Mayor is authorized to enter into a three-year contract with Fire Recovery USA for fee processing and collection services relating to applicable state and municipal fire code enforcement, under terms and conditions acceptable to the Director of Fire and Rescue and the Director of Law.

 

Section 2. That the Mayor is authorized to accept and deposit net fee revenue into the General Fund, Account Code 1001-53000-3341002STDSTD. 

 

SECTION 3. That this Council finds and determines it is in the best interest of the City to waive the competitive procurement requirements of TMC Chapter 187 for the reason that Fire Recovery USA software is the fee collection component of Streamline Automation Systems, Fire’s current inspection software, which permits seamless interface for fee collection and resultantly yields higher revenues as opposed to other collection software.

 

SECTION 4. That the Finance Director is authorized to issue warrant or warrants against the above Account Code in payment of the above-authorized obligations upon presentation of the proper voucher or vouchers.

 

SECTION 5. That this Ordinance hereby is declared to be an emergency measure and shall be in force and effect from and after its passage. The reason for the emergency lies in the fact that same is necessary for the immediate preservation of the public peace, health, safety and property, and for the further reason that the Ordinance must be immediately effective to improve state and municipal fire code enforcement fee processing and collection services.
