Title

Authorizing the closure of a portion of Emerald Avenue, between Hobart and South St. Clair, in the City of Toledo, Lucas County Ohio; and declaring an emergency.

SUMMARY & BACKGROUND:

The City of Toledo is the fee owner of a triangular parcel of land located at 803 S. St. Clair Street (TD 18-72451), also being known as “Maya Park”.  This parcel is bounded by South St. Clair Street, Hobart Street, and the currently dedicated right-of-way of Emerald Avenue. 

                     

The dedicated right-of-way of Emerald, between South St. Clair Street and Hobart Street, is currently not open for vehicular traffic and has park improvements located thereon. It is also blocked off for vehicular traffic at South St. Clair Street with bollards, and at Hobart Street with large concrete blocks.  This ordinance seeks to formally close the right-of-way of Emerald, between Hobart and South St. Clair, from vehicular traffic, so that it can continue to be open and available to the public as part of Maya Park, while maintaining any utilities in this area and further reserving the City’s right to potentially open this area up for vehicular traffic in the future, should it cease to be used for public park purposes.

 

Summary

NOW, THEREFORE, Be it ordained by the Council of the City of Toledo:

 

SECTION 1.                     That the portion of dedicated right-of-way of Emerald, between Hobart Street and South St. Clair Street, is closed for vehicular traffic.

 

SECTION 2.                     That the closure herein provided for shall be appropriately delineated or otherwise marked by an appropriate barricade, fencing, or other appropriate improvements that will prevent vehicular traffic only from entering onto or otherwise traversing the closed area.

 

SECTION 3.                     That the closure authorized by this ordinance be properly recorded in the appropriate public records of the office of the Lucas County Recorder.

 

SECTION 4.                     That it is found and determined that all formal actions of Council concerning and relating to the passage of this Ordinance were adopted in an open meeting of Council, and that all deliberations of Council and any of its committees that result in such formal action were in meetings open to the public in compliance with all legal requirements, including Section 121.22 of the Ohio Revised Code.

 

SECTION 5.  That this Ordinance is declared to be an emergency measure and shall be in force and effect from and after its passage.  The reason for the emergency lies in the fact that same is necessary for the immediate preservation of the public peace, health, safety and property, and for the further reason that this Ordinance must be immediately effective so that the closed area can be improved and utilized by the public as part of Maya Park.

 

Vote on emergency clause:  yeas 10, nays 0.
