SUMMARY & BACKGROUND:

The Toledo Municipal Code Part Thirteen - Building Code, Chapter 1313.04 (d) Continuing Education, specifies the continuing education requirements for license renewal held by all home improvement and remodeling contractors. This ordinance changes the 30hrs - every three years requirement to 10hrs - every year. The Board of Control has agreed to the proposed change.

 

Summary

NOW, THEREFORE, Be it ordained by the Council of the City of Toledo:

 

SECTION 1. That the existing Toledo Municipal Code 1313.04 (d) Continuing Education, which reads as follows:

 

1313.04 (d) Continuing Education

 

(d)                     Continuing Education. All home improvement and remodeling contractors licensed with the City of Toledo shall be required to complete thirty (30) hours of continuing education in their respective field and as established by the Board of Control within a three (3) year period. If the licensee fails to submit proof of the required continuing education during the renewal period at the end of the third year, said license shall be suspended for a period of ninety (90) days. If proof of continuing education is not provided within the ninety (90) days, said license will be revoked and the licensee must re-apply as a new applicant subject to the requirements of Chapter 1313.

SECTION 2. That a new Toledo Municipal Code 1313.04 (d) Continuing Education, is enacted to read as follows:

 

1313.04 (d) Continuing Education

(d)                     Continuing Education. All home improvement and remodeling contractors licensed with the City of Toledo shall be required to complete ten (10) hours of continuing education yearly, as established by the Board of Control. If the licensee fails to submit proof of the required continuing education for the annual license renewal, the license shall not be renewed and the licensee must reapply as a new applicant subject to the requirements of Chapter 1313.

 

SECTION 3. That this Ordinance is declared to be an emergency measure and shall take effect and be in force from and after its passage. The reason for the emergency lies in the fact that same is necessary for the immediate preservation of the public peace, health, safety and property, and for the further reason that this legislation is needed to correct and reconcile provisions of the code.
