SUMMARY & BACKGROUND:

The City of Toledo has a number of motor vehicles and equipment which have been and are expected to be retired from service. The sale of such motor vehicles, equipment, and various city unneeded salvage at public auctions, benefits the City of Toledo. The Division of Facility and Fleet Operations and the Division of Purchasing are responsible for the disposal of motor vehicles, equipment, and various city unneeded salvage and requires the services of a professional auctioneer to advertise, organize, and conduct said public auctions. Currently, in person auctions are done once a year at the Facility and Fleet location on Expressway Drive. Equipment is sorted and stored throughout the year and marked by employees. The process is time consuming and takes up valuable space and resources at the Fleet garage. Additionally, equipment is only sold on site for one day. This limits selling and revenue capabilities.

 

Public Surplus offers an online auction system specifically for municipalities to sell and purchase equipment. Equipment can be uploaded to the site as it comes in and sold at any time. The city can set time and pricing parameters and buyers are responsible for all fees and pick-up of equipment. 

 

Summary

NOW, THEREFORE, Be it ordained by the Council of the City of Toledo:

 

                       SECTION 1.                     That the Mayor is authorized to declare retired motor vehicles, associated equipment, and various salvage as no longer needed for a municipal purpose and sell same at public auctions.

 

SECTION 2. That the Mayor is authorized to enter into a contract with Public Surplus for the sale of vehicles, equipment and salvage specified in Section 1, upon terms and conditions acceptable to the Director of Law and the Director of Public Service.

 

SECTION 3. That this Council finds and determines that it is in the best interest of the City to waive the competitive procurement requirements of Toledo Municipal Code Chapter 187 for the reason that the Department of Public Service has determined that Public Surplus provides the lowest cost and most efficient option for the disposal of surplus property.

 

             SECTION 4. That the Director of Finance is authorized to make such expenditures and deposits from and/or to various funds as may be required to effectuate the purposes of this Ordinance.

 

                       SECTION 5. That this Ordinance, being an emergency measure, shall take effect and be in force from and after its passage. The reason for the emergency lies in the fact that the Ordinance is necessary for the immediate preservation of the public health, safety and property and for the further reason that the Ordinance must be immediately effective in order to maximize the proceeds from the sale of municipally-owned motor vehicles and equipment.
