SUMMARY & BACKGROUND:
During construction of the Anthony Wayne Trail, it was discovered that a portion of the embankment along the Trail has eroded. Not only is the City unable to construct the multi-use path due to the erosion but also, unless stabilized, the embankment will continue to erode and ultimately affect the road. The Division of Engineering and Construction Management took informal competitive bids for the slope improvement with Geddis Paving and Excavating being the lowest and best.

Summary
NOW, THEREFORE, Be it ordained by the Council of the City of Toledo:

SECTION 1. That the Mayor is authorized to enter into contract in the amount of $319,204.50 with Geddis Paving and Excavating Co. for emergency slope improvements on the Anthony Wayne Trail Roadway Reconstruction Project, upon such terms and conditions as are acceptable to the Director of the Department of Transportation and the Director of Law.

SECTION 2. That Council finds and determines that, pursuant to TMC Chapter 187.20, formal competitive bidding was waived for the reason that it was an emergency that could not have been reasonably foreseen and would result in an interruption of the current Anthony Wayne Trail Roadway Reconstruction project and the cost has been deemed necessary reasonable by the Director of the Department of Transportation.
