SUMMARY & BACKGROUND:

Currently, bus benches throughout the city are placed by advertising companies.  These benches are placed by such companies based on where they will have the greatest advertising visibility rather than based on the need of transit riders.  This has led to ADA issues within the right-of-way as well as blight in some areas.  The City of Toledo and the Toledo Area Regional Transit Authority (TARTA) are proposing that bus benches be placed throughout the city where the need is greatest for transit riders based on rider data supplied by TARTA.  These benches will be owned by the City of Toledo and will be placed properly at each stop to ensure ADA compliance and will be accompanied by refuse receptacles for the comfort of the residents using TARTA services.  These benches will not have advertising and therefore will be more visually appealing than the benches currently in the right-of-way.  The city is proposing that benches be placed at 50 to 60 bus stops that have an average daily rider count of 20 or more people.  The exact location of these benches will be decided in consultation with TARTA.

 

Summary

NOW, THEREFORE, Be it ordained by the Council of the City of Toledo:

 

SECTION 1.  That the Mayor is authorized to enter into and execute an agreement with and accept financial assistance from the Toledo Area Regional Transit Authority for the TARTA LITE bench program upon such terms and conditions as approved by the Director of Transportation and the Director of Law.

 

SECTION 2. That the Mayor is authorized to accept and deposit proceeds from the Toledo Area Regional Transit Authority into the Capital Improvements Project Fund to Account Code 5040-35000- 8CP2333BUSBNH in an amount not to exceed $300,000 for the TARTA LITE bench program.

 

SECTION 3.                     That an amount not to exceed $300,000 is appropriated from the unappropriated proceeds in the Capital Improvement Program Fund into the account code listed above for the TARTA LITE program; and further authorizing the expenditure of same.

 

SECTION 4.                     That the Mayor is authorized to prepare plans and specifications and to enter into contracts after accepting bids for the TARTA LITE program as necessary to complete the improvements identified above including such items as labor, materials, construction testing, professional services, and for property appraisals, title work, negotiations, acquisition, and environmental contamination studies that are necessary to acquire additional rights-of-way as required.  Contracts shall contain such terms and conditions as the mayor may deem requisite and proper and shall be subject to approval by the Director of Transportation and the Director of Law.

 

SECTION 5.  That the Director of Finance is authorized to issue their warrant or warrants against the account codes listed in Section 2 above in an amount not to exceed $300,000 in payment of the obligations upon presentation of the proper voucher or vouchers.

 

SECTION 6.                      That the disappropriation of any remaining budget to fund balance is authorized at project closeout.

                     

SECTION 7.  That this Ordinance is declared to be an emergency measure and shall be in force and effect from and after its passage.  The reason for the emergency lies in the fact that same is necessary for the immediate preservation of the public peace, health, safety, and property and for the further reason that this Ordinance must be immediately effective in order to facilitate this work to eliminate blight and ADA non-compliance.
