SUMMARY & BACKGROUND:

The Division of Road & Bridge Maintenance has primary responsibility for the maintenance of levees and harbors to comply with USACE and FEMA requirements.  As climate change continues and storm intensities increase, the levees and harbor require more robust embankment protection and erosion control.  In order to protect property within the city of Toledo, it is necessary to design and construct rip rap protection, which is large rock used to prevent erosion on slopes, improve sheet pile walls, improve storm water closure devices, and eliminate washouts. Most specifically, Point Place levee is in need of sheet pile wall improvements behind Edgewater School, stormwater closure device replacement is needed along the Ottawa River in the vicinity of the yacht clubs, and rip rap replacement is needed throughout.  Swan Creek Levee is also in need of additional rip rap. 

 

Summary

NOW, THEREFORE, Be it ordained by the Council of the City of Toledo:

                     

                     SECTION 1.                       That an amount not to exceed $600,000 is authorized for expenditure from the Capital Improvement Fund Account Code 5040-23100-8CP2331LEVEES for the Road & Bridge Maintenance Levees and Harbor capital improvement program.

                     

                     SECTION 2.  That the Mayor is authorized to prepare plans and specifications, as well as authorized to accept bids and enter into contracts necessary to complete the improvements identified above including such items as labor, materials, construction testing,  professional services, and for property appraisals, title work, negotiations, acquisition, and environmental contamination studies that are necessary to acquire additional rights-of-way as required.  Contracts shall contain such terms and conditions as the mayor may deem requisite and proper and shall be subject to approval by the Directors of Law and Transportation.

                     

                     SECTION 3.                       That the Finance Director is authorized to draw their warrant or warrants against the account code identified in Section 1 above in an amount not to exceed $600,000 in payment of the obligations authorized above upon presentation of the proper voucher or vouchers.

 

                     SECTION 4.                     That this Ordinance is declared to be an emergency measure and shall take effect and be in force immediately from and after its passage.  The reason for the emergency lies in the fact that same is necessary for the preservation of the public peace, health, safety, and property and for the further reason that this Ordinance must be immediately effective in order to improve and protect the city’s levee and harbor systems.

 

                     Vote on emergency clause:  yeas 10, nays 0.
