Authorizing the mayor to enter into a donor agreement with We Are Traffic, LLC for the conveyance by gift of fifteen (15) bike racks previously part of ToleGo Bikes System; and declaring an emergency.

SUMMARY & BACKGROUND:
The City of Toledo accepted receipt of the bike racks as part of the ToleGo Bike Share. Ownership of the units was transferred from Metroparks Toledo to the City of Toledo as a bike share system was launched. Metroparks Toledo received the bike racks using awarded grant funds. The ToleGo Bike Racks are no longer in use by the City of Toledo.
The City of Toledo was approached by We Are Traffic, LLC and would like to accept the bike racks and put them to their highest and best use for the residents of the City of Toledo. We Are Traffic exists to promote cycling as a viable form of transportation in the Greater Toledo Area by supporting bike related events and activities. Their programming seeks to change behavior by giving people the tools they need to ride a bike.
We are Traffic, LLC will repurpose the bike racks through a network of area partners and agencies who share an interest in supporting the need for individuals seeking personal freedom of mobility, inclusive of active transportation allowing individuals access to daily quality of life and employment opportunities.
Summary
NOW, THEREFORE, Be it ordained by the Council of the City of Toledo:
SECTION 1. That the mayor is authorized to enter into a donor agreement with We Are Traffic, LLC for the conveyance by gift of fifteen (15) former ToleGo Bike Racks.
SECTION 2. That given the unique nature of this collection and that the collection is no longer needed for a municipal purpose, this Council finds and determines that conveyance by gift of this collection is in the best interest of the City notwithstanding any provisions of the TMC Chapter 187.
