Title

Authorizing the expenditure of $55,000 from the Street Construction Maintenance and Repair Fund for the purchase of one pickup truck for the Division of Traffic Management; waiving the competitive procurement requirements of TMC Chapter 187; authorizing the mayor to enter into the necessary contracts for said purchase; and declaring an emergency.

Body

SUMMARY & BACKGROUND:

The Division of Traffic Management is in need of one (1) pickup truck for the operation of maintaining the City’s infrastructure for traffic signals and fiber optic communications.  This Ordinance authorizes the expenditure of funds needed to purchase one pickup truck by means of the Street Construction Maintenance and Repair Fund. The total amount to be expended for the vehicle is $55,000. The vehicle will enable traffic signal personnel to perform their duties in building, repairing, and maintaining the traffic signals for the citizens of the City of Toledo to travel.

Summary

NOW, THEREFORE, Be it ordained by the Council of the City of Toledo:

SECTION 1. That the expenditure of an amount not to exceed $55,000 is authorized from the appropriated balance of the Street Construction Maintenance and Repair Fund Account Code 2014-22500-2413003STDSTD for the purchase of one pickup truck.

SECTION 2. That this Council finds it in the best interest of the City to waive the competitive procurement requirements of Toledo Municipal Code Chapter 187 for this purchase for the reason that there is a proven lack of supply of available trucks and that a truck has been located and held in order to enter into a contract for the purchase of this vehicle.

SECTION 3. That the mayor is authorized to enter into a contract with Brondes Ford for the purchase of one pickup truck, upon terms and conditions acceptable to the Directors of Law and the Toledo Department of Transportation.

SECTION 4.  That the Finance Director is authorized to draw their warrant or warrants against the above account code upon presentation of properly approved voucher or vouchers in an amount not to exceed $55,000 in payment of the above-authorized obligations.

SECTION 5.  That this Ordinance, being an emergency measure, shall take effect and be in force from and after its passage.  The reason for the emergency lies in the fact that it is necessary for the immediate preservation of the public peace, health, safety, and property, and for the further reason that the Ordinance must be immediately effective in order to purchase one pickup truck in the furtherance of the Division of Traffic Management duties to be able to build, repair and maintain the City’s 493 intersections and miles of underground communications.
