Title

Authorizing the mayor to enter into agreements to update the pavement condition index ratings for the improved residential roadway system and pavement management system; waiving the competitive bidding requirements of TMC Chapter 187; and declaring an emergency.

Body

SUMMARY & BACKGROUND:

The contract will utilize approximately $330,000 of already appropriated funding that was appropriated and authorized for expenditure under ordinances 109-18, 186-19, and 12-22.  This ordinance allows the mayor to waive the competitive bidding requirements of the TMC Chapter 187 and enter into a contract with Engineering & Research International, Inc. (ERI) to update the pavement condition index (PCI) ratings for the improved residential roadway system and the pavement management system.  It is necessary to utilize ERI for this project to maintain consistency in the rating of the roadways and for additional updating of the pavement management system as they were the firm that built our pavement management system and provided the PCI ratings in 2017 and 2020. Ratings are done on a 3-year cycle.  It is critical that ERI be utilized to maintain consistency in the PCI ratings and consistency of the data in the pavement management system.

Summary

NOW, THEREFORE, Be it ordained by the Council of the City of Toledo:

SECTION 1.  That the mayor is authorized to enter into an agreement with Engineering and Research International (ERI) to update the pavement condition index (PCI) ratings for the improved residential roadway system and the pavement management system. Said agreements shall contain such terms and conditions as the mayor may deem requisite and proper, and shall be subject to approval by the Director of Law and the Director of Transportation.

SECTION 2.  That this Council finds and determines it is in the best interest of the City to waive the competitive bidding requirements of Toledo Municipal Code Chapter 187 for the reason that contracting with ERI allows the city to maintain consistency in the PCI ratings and consistency of the data in the pavement management system.

SECTION 3. That this Ordinance is declared to be an emergency measure and shall take effect and be in force from and after its passage. The reason for the emergency lies in the fact that this ordinance is necessary for the immediate preservation of the public peace, health, safety, and property, and for the further reason that this ordinance must be immediately effective in order to permit timely updates to the pavement condition index (PCI) ratings for the improved residential roadway system and the pavement management system.
