Title
Authorizing the mayor to enter into a software license agreement with DLT Solutions, LLC for the renewal of 37 Autodesk licenses and related software and maintenance for a period of 12 months; waiving competitive procurement provisions of the TMC Chapter 187; authorizing the expenditure of an amount not to exceed $22,000 from the Sewer Operating Fund; authorizing the expenditure of an amount not to exceed $8,000 from the Street Construction Maintenance and Repair Fund; and declaring an emergency.

SUMMARY & BACKGROUND:
This ordinance waives the competitive bidding requirements of the TMC 187 and further authorizes the expenditure of $30,000 in order to purchase software license agreements with DLT Solutions, LLC, along with related software and maintenance, for thirty-seven (37) seats of Autodesk. This program is utilized for the design of sewer, water, roadway, and stormwater projects. Funding for this expenditure is included in both Engineering and Construction Management’s and Road and Bridge Maintenance’s 2022 operating budget.
DLT Solutions, LLC is the Master Government Aggregator for the entire U.S. Market and Government Services Administration (GSA) contract holder for Autodesk; therefore, all quotes created for Autodesk must be generated by DLT. Further, DLT provides free technical support through IMAGINiT, and is designated a platinum partner with Autodesk, providing the highest level of service, support, and training.
Summary
NOW, THEREFORE, Be it ordained by the Council of the City of Toledo:
SECTION 1. That the mayor is authorized to enter into software license agreements with DLT Solutions, LLC for one year for thirty-seven (37) seats of Autodesk, upon such terms and conditions as the mayor may deem requisite and proper, subject to approval by the Department of Law and the Director of the Department of Transportation.
SECTION 2. That this Council finds it in the best interest of the City to waive the competitive procurement requirements of Toledo Municipal Code Chapter 187 for the purchase of the Autodesk licenses for the reason that DLT Solutions, LLC is the Master Government Aggregator for the U.S. Market and provides the highest level of service, support, and training available.
SECTION 3. That an amount not to exceed $22,000 is authorized for expenditure from the Sewer Operating Fund Account Code 6070-35000-4000508STDSTD for the purchase of the Autodesk license agreements.
SECTION 4. That an amount not to exceed $4,000 is authorized for expenditure from the Street Construction Maintenance and Repair Fund Account Code 2014-23100-2411001STDSTD for the purchase of the Autodesk license agreements.
SECTION 5. That an amount not to exceed $4,000 is authorized for expenditure from the Street Construction Maintenance and Repair Fund Account Code 2014-23100-2431001STDSTD for the purchase of the Autodesk license agreements.
SECTION 6. That the Director of Finance is authorized to issue their warrant or warrants against the account codes listed above in an amount not to exceed $30,000 in payment of the above-authorized obligations upon presentation of the proper voucher or vouchers.
SECTION 7. That this Ordinance is declared to be an emergency measure and shall take effect and be in force from and after its passage. The reason for the emergency lies in the fact that this Ordinance is necessary for the immediate preservation of the public peace, health, safety, and property, and for the further reason that this Ordinance must be immediately effective in order to provide necessary equipment for the Division of Engineering and Construction Management.
