SUMMARY & BACKGROUND:

This Ordinance authorizes the expenditure of funds from the Capital Improvement (CIP) Fund for the purchase of replacement equipment for the Hoffman Road Landfill.   The resources will support replacement of heavy equipment and infrastructure that have surpassed useful life to support operations and regulatory requirements.  

 

The resources will be used for the purchase of a refurbished CAT D8 Dozer, leachate lift station refurbishment, environmental applicator and a roll-off truck. 

                     

Summary

NOW, THEREFORE, Be it ordained by the Council of the City of Toledo:

 

SECTION 1.                      That the mayor is authorized to enter into a contract with Best Equipment for the purchase of a refurbished CAT D8 dozer for the Hoffman Road Landfill upon such terms and conditions that shall be approved by the Director of Public Service and the Director of Law.

 

SECTION 2. That Council finds and determines that is in the best of interest of the City to waive the competitive bidding process as required under Chapter 187 of the Toledo Municipal Code for Best Equipment for the purchase of a refurbished CAT D8 dozer based on immediate availability.

 

SECTION 3. That the Mayor is authorized to enter into a contract with Buckeye Pumps for leachate control system refurbishment upon such terms and conditions that shall be approved by the Director of Public Service and the Director of Law.

 

SECTION 4. That Council finds and determine that is in the best of interest of the city to waive the competitive bidding process as required under Chapter 187 of the Toledo Municipal Code for Buckeye Pumps for leachate control system refurbishment to meet original specifications.

 

SECTION 5.                      That the Mayor is authorized to accept bids and award contracts and/or enter into an agreement using cooperative purchasing or state term contracts for the purchase of an environmental applicator and a roll off truck, upon such terms and conditions that shall be approved by the Director of Public Service and the Director of Law. 

 

SECTION 6. That the amount of $750,000 is authorized for expenditure from the Capital Improvement Fund Account Code be 5040-24500-8CP2227LNDEQP for the purchases and activities referenced in Sections 1 through 5.

 

SECTION 7.  That the Finance Director is authorized to draw their warrant or warrants against the above Account Code in an amount not to exceed $750,000 in payment of all above-authorized obligations upon presentation of proper voucher or vouchers.

 

SECTION 8. That this Ordinance is declared to be an emergency measure and shall be in force and effect from and after its passage.  The reason for the emergency lies in the fact that the same is necessary for the immediate preservation of the public peace, health, safety and property, and for the further reason that the Ordinance must be immediately effective in order for the City of Toledo to ensure that the Hoffman Road Landfill continues to operate in a manner supportive of continuous daily city services to the community and in compliance with the applicable regulatory requirements.
