SUMMARY & BACKGROUND:

This Ordinance authorizes the appropriation and expenditure of funds from the Capital Improvement Fund for the purchase of an excavator for the Hoffman Road Landfill.   An excavator is required for daily maintenance and operations of the landfill to ensure compliance with the OEPA.

 

The Hoffman Road Landfill has a 1998 CAT 385 excavator that is currently not operational and requiring significant repair.  Based on the age of the machine, continued costly repairs, and overtime, it has been decided to replace this machine. Southeastern Equipment Company was determined to be the lowest and best for this purchase utilizing the Sourcewell cooperative program.  Southeastern Equipment Company has a new CASE excavator on the ground locally and immediately available for purchase that is well equipped, relative to the price.  All rental fees incurred from Southeastern Equipment Company will be credited towards the purchase of the new CASE excavator.

                     

Summary

NOW, THEREFORE, Be it ordained by the Council of the City of Toledo:

 

SECTION 1.                      That the Mayor is authorized to enter into a contract with Southeastern Equipment Company utilizing Sourcewell or other cooperative purchasing organizations, to purchase an excavator and attachments, upon terms and conditions acceptable to the Mayor, the Director of Public Service and the Director of Law.

 

SECTION 2. That the expenditure of an amount not to exceed $355,000 is authorized from the Capital Improvement Fund Account Code 5040-25000-8CP2228LNDEXC for the purchase referenced in Section 1.

 

SECTION 3.  That the Finance Director is authorized to draw their warrant or warrants against the above Account Code in an amount not to exceed $355,000 in payment of the above-authorized obligations upon presentation of proper voucher or vouchers.

 

SECTION 4. That this Ordinance is declared to be an emergency measure and shall be in force and effect from and after its passage.  The reason for the emergency lies in the fact that the same is necessary for the immediate preservation of the public peace, health, safety and property, and for the further reason that the Ordinance must be immediately effective in order for the City of Toledo to ensure that the Hoffman Road Landfill continues to operate in a manner supportive of continuous daily city services to the community and in compliance with the applicable regulatory requirements.

 

Vote on emergency clause:  yeas 11, nays 0.
