Creating parameters for timely submission of Charter Amendments to Toledo City Council; and declaring an emergency.
Summary
WHEREAS, the Charter Review Committee was created under Section 239 of the Toledo City Charter “to review this Charter in detail, as well as possible amendments to the Charter and recommend changes that it deems appropriate, which shall be presented to Council”; and
WHEREAS, the Committee “shall submit periodic reports to the Mayor and Council in order that the Mayor, the Council and the public shall be informed of its activities”; and
WHEREAS, the current Charter Review Committee has been meeting monthly since December 2021; and
WHEREAS, Toledo City Council appreciates the commitment and volunteer-public service of this committee on behalf of the City of Toledo; and
WHEREAS, the committee has submitted Charter changes to Toledo City Council on April 27, 2022 and June 2, 2022; and
WHEREAS, the Toledo City Charter Section 5 submits that any proposed amendments “shall be voted upon at the next regular municipal election if one shall occur not less than sixty, nor more than one hundred and twenty days after the passage of a resolution therefor by the Council.”; and
WHEREAS, the next Municipal Election is November 8, 2022 and to meet this deadline of 60 days, but preferable 75 days, would mean submission of charter amendment changes to the Lucas County Board of Elections would occur between August 25, 2022 and September 9, 2022; and
WHEREAS, Toledo Council should be afforded the proper amount of time to deliberate to consider changes to the Toledo City Charter; and
WHEREAS, the Charter Review Committee shall submit any proposed changes to Toledo City within 30 days of the September 9, 2022 deadline to submit Charter Amendments to the Lucas County Board of Elections; NOW, THEREFORE,
Be it resolved by the Council of the City of Toledo:
SECTION 1. The Toledo Charter Review Committee that is established by Section 239 of the Toledo City Charter shall submit to Toledo City Council any proposed changes to the Toledo City Charter no less than 30 days before the September 9, 2022 deadline to submit Charter Amendments to the Lucas County Board of Elections. The Toledo Charter Review Committee may submit proposed amendments of the Toledo City Charter to Toledo City Council at any time, but no recommendations will be considered within 30 days of the required deadline to file with the Lucas County Board of Elections.
SECTION 2. That all formal actions concerning and relating to the passage of this Resolution were passed in an open meeting of this Council, and that all deliberations of this Council and any of its committees that resulted in such formal action were in meetings open to the public, in compliance with all legal requirements including Section 121.22 of the Ohio Revised Code.
SECTION 3. That this Resolution is declared to be an emergency measure necessary for the immediate preservation of the public peace, health, safety and property of the City, and for the further reason that this Resolution is required to be immediately effective in order to meet the aforementioned deadline for proper review of any amendments of the Toledo City Charter; wherefore, this Resolution shall be in full force and effect immediately after its passage or at the earliest time allowed by law.
