Title

Authorizing the mayor to enter into a contract for the Green Infrastructure Invasives Control Project; authorizing the expenditure of an amount not to exceed $37,485 from the Storm Water Operating Fund; and declaring an emergency.

Body

SUMMARY & BACKGROUND:

This Ordinance authorizes a contract for the Green Infrastructure Invasives Control Project. The stormwater control measures called out in this project are components of the City’s infrastructure and critical to complying with the Ohio EPA National Pollutant Discharge Elimination System (NPDES) permit for storm water. Bids for said project have been received and A & J Landscape, LLC has been selected as the lowest and best bidder.

Summary

NOW, THEREFORE, Be it ordained by the Council of the City of Toledo:

SECTION 1. That the mayor is authorized to enter into a one-year contract with two one-year renewal options for the Green Infrastructure Invasives Control Project upon terms and conditions acceptable to the Director of Law and the Director of Public Utilities.

SECTION 2. That subject to future appropriations the expenditure of an amount not to exceed $37,485 annually is authorized from the Storm Water Operating Fund Account Code 607A-38000-4000552STDSTD for the Green Infrastructure Invasives Control Project.

SECTION 3. That the Finance Director is authorized to issue their warrant or warrants against the account code above in an amount not to exceed those authorized above in payment of the obligations incurred pursuant to the above authorized contracts upon presentation of proper voucher or vouchers.

SECTION 4.                     That this Ordinance is declared to be an emergency and shall take effect and be in force from and after its passage. The reason for the emergency lies in the fact that this Ordinance is necessary for the immediate preservation of the public peace, health, safety and property of the city and for the further reason that this Ordinance must be immediately effective in order to implement this program within the shortened time schedule of an effective maintenance program for vegetated sites.
