SUMMARY & BACKGROUND:
This Ordinance authorizes the appropriation and expenditure of $250,000 from the Sewer Replacement Fund for the Division of Water Reclamation Tank 12 Rehabilitation Project. The Water Reclamation Plant (Plant) has twelve (12) secondary treatment clarifiers. Tank 12 is the largest clarifier and is used extensively during wet weather events to allow the plant to process large flows associated with wet weather events. This tank is currently out of service, and because of this, the plant is in jeopardy of being unable to process those large volumes. The clarifier was originally installed in 1996 and has not been rehabilitated since that time. This work is necessary to maintain safe, reliable solids process as well as to maintain compliance with the NPDES discharge permit requirements, as set forth by the Ohio EPA.
Summary
NOW, THEREFORE, Be it ordained by the Council of the City of Toledo:
SECTION 1. That the appropriation of $250,000 is authorized from the Sewer Replacement Fund to Account Code 6073-36000-4UC0622STDSTD for the purchase of equipment and construction services necessary to facilitate the Tank 12 Rehabilitation Project at the Water Reclamation Plant, and further authorizing the expenditure of the same.
SECTION 2. That the mayor is authorized to enter into a contract with Evoqua Water Technologies LLC for the Tank 12 Rehabilitation Project, upon terms and conditions acceptable to the Director of Public Utilities and the Director of Law.
SECTION 3. That this Council finds and determines it in the best interest of the City to waive the competitive procurement requirements of TMC Chapter 187 for the reason that Evoqua Water Technologies LLC is the sole source provider of the necessary parts and is uniquely familiar with part installation and rebuild of existing tank mechanisms.
SECTION 4. That the Finance Director is authorized to draw their warrant or warrants against the above Account Code in an amount not to exceed $250,000 in payment of the above authorized obligations upon presentation of the proper voucher or vouchers.
SECTION 5. That the disappropriation of any remaining budget to fund balance is authorized at project closeout.
SECTION 6. That the Ordinance is declared to be an emergency measure and shall take effect and be in force from and after its passage. The reason for the emergency lies in the fact that this Ordinance is necessary for the immediate preservation of the public peace, health, safety and property, and for the further reason that this Ordinance must be immediately effective in order to maintain the operational integrity of the Water Reclamation Plant, and to maintain compliance with the NPDES discharge permit requirements, as set forth by the Ohio EPA.
