Supporting House Bill 266 which eliminates the Statute of limitations for Rape, eliminates Spousal exceptions and extends the period of limitations for Childhood Sexual Abuse.

Summary
WHEREAS, April is Sexual Assault awareness month, Toledo City Council expresses its support for House Bill 266 legislative language changes that will eliminate statutes of limitation for rape and child sexual abuse; and eliminate the spousal exemption; and

WHEREAS, HB 266 would extend the statute of limitations for childhood sexual abuse survivors: from a 12-year period to 37 years after the survivor turned 18; Grant survivors of childhood sexual abuse older than 55 a three-year window upon new evidence or discovery of abuse to file a lawsuit and eliminate spousal exemptions from rape; and

WHEREAS, in Ohio over 5,000 children annually carry around trauma from sexual abuse; but only about 38% ever report it; and

WHEREAS, an estimated 33% of rapes are committed by a current or former partner, sexual abuse is a crime that exists in silence, but it is a crime that must be stopped; and

WHEREAS, under the current Ohio Revised Code, prosecution against a perpetrator of rape or sexual battery must begin within 25 years after the commission of or attempt to commit the crime; this is an extension of the 20-year statute of limitations that was in place prior to 2015; and

WHEREAS, 1 in 4 girls and 1 in 13 boys will experience some form of childhood sexual abuse; justice must assist in the healing of this crime; and

WHEREAS, HB 266 was introduced by state Reps. Tavia Galonski, and Jessica Miranda; many others are adding their names as co-sponsors; NOW, THEREFORE,

SECTION 1. That Toledo City Council strongly supports House Bill 266 changes and urges all legislators to vote in the affirmative for its passage.
