SUMMARY & BACKGROUND:

R&B Debris of Ohio, LLC is a commercial enterprise, whose primary business is hauling, recycling and disposing of municipal, industrial, and construction/demolition solid waste. R&B would like to utilize the Hoffman Road Landfill to dispose of construction and demolition debris. R&B will deliver to the Hoffman Road Landfill waste that has been pre-approved by the city and is permissible under Ohio Environmental Protection Agency (EPA) regulations. R&B anticipates the average tonnage over the life of this agreement to be 30,000 tons.

 

Summary

NOW THEREFORE, Be it ordained by the Council of the City of Toledo:

 

SECTION 1.  That the mayor is authorized to enter into agreement with R&B Debris of Ohio, LLC for the acceptance of construction and demolition debris at the Hoffman Road Landfill, upon terms and conditions acceptable to the Director of Public Service and the Director of Law.

 

SECTION 2.  That R&B Debris of Ohio, LLC will pay the city a disposal fee per ton of $29.50 for any and all waste delivered by the customer to the Hoffman Road Landfill pursuant to the agreement authorized in Section 1.

 

                     SECTION 3.  That all revenues collected are deposited to the General Fund and Solid Waste Trust Fund as defined by the Toledo Municipal Code Chapter 963.08.

 

SECTION 4.  That this Ordinance, being an emergency measure, shall take effect and be in force from and after its passage. The reason for the emergency lies in the fact that the Ordinance is necessary for the immediate preservation of the public peace, health, safety, and property and for the further reason that this Ordinance must be immediately effective in order to enhance General Fund and Solid Waste Trust Fund.
