Title

Authorizing the expenditure of $26,535 from the Storm Water Operating Fund for supporting the Second Edition of the Western Lake Erie Report Card; waiving competitive proposal requirements of Toledo Municipal Code (TMC) Chapter 187; and declaring an emergency.

SUMMARY & BACKGROUND:

The City of Toledo, Lucas County Commissioners and the Lucas County Sustainability Commission would like to use a phased approach to identify, quantify, and reduce the impacts from nutrient sources potentially contributing to Harmful Algal Blooms (HABs) in the Western Lake Erie Basin. Strategy will be consistent with the United States Environmental Protection Agency’s (EPA’s) Nine Element Watershed Plan Requirements for Impaired Waters. The EPA requires that nine elements be addressed in watershed plans funded with incremental Clean Water Act Section 319 funds and strongly recommends that they be included in all other watershed plans intended to address water quality impairments. This funding will provide the modeling that is necessary for the project.

 

This ordinance is for the Second Edition of the Western Lake Erie Report Card improved lake conditions which directly affect the fishing/tourism industry.

 

Summary

NOW, THEREFORE, Be it ordained by the Council of the City of Toledo:

 

                     SECTION 1.  That the expenditure of $26,535 is authorized from the Storm Water Operating Fund, Account Code 607A-38000-4000552STDSTD, to Lucas County Commissioners for the City of Toledo’s share of the cost of the Second Edition of the Western Lake Erie Report Card.

 

                     SECTION 2. That the Mayor is authorized to enter into an intergovernmental cooperative agreement with Lucas County Board of Commissioners for the purposes authorized in Section 1.

 

                     SECTION 3.                     That Council finds and determines it in the best interest of the City of Toledo to waive the competitive proposal process as required under Chapter 187 of the Toledo Municipal Code for the reason that this is the Second Edition of the Western Lake Erie Report Card, and an ongoing project with Lucas County Commissioners and the Lucas County Sustainability Commission.

 

                     SECTION 4.                      That the Finance Director is authorized to issue their warrant or warrants against the account code listed in Section 1 in amounts not to exceed $26,535 in payment of the obligations incurred upon presentation of proper voucher or vouchers

 

           SECTION 5. That this Ordinance is declared to be an emergency measure and shall be in force and effect from and after its passage.  The reason for the emergency lies in the fact that this Ordinance is necessary for the immediate preservation of the public peace, health, safety and property, and for the further reason that this Ordinance must be immediately effective in order to timely move forward the Second Edition of the Western Lake Erie Report Card.

Vote on emergency clause:  yeas 12, nays 0.
