Title

Authorizing the mayor to enter into an amended Uniform Water and Supply Agreement with Fulton County Ohio for the purpose of including the Village of Delta Ohio within the service area; and declaring an emergency.

 

Body

SUMMARY & BACKGROUND:

The County of Fulton approached the City of Toledo for an expansion of the service area near and including the Village of Delta. This will allow for added water sales to Fulton with no changes to the terms and conditions of the current contract except the size of the service area (see attached).

 

Summary

NOW, THEREFORE, Be it ordained by the Council of the City of Toledo:

 

SECTION 1.                     That the mayor is authorized to enter into an amended Uniform Water and Supply Agreement with Fulton County Ohio for the purpose of including the Village of Delta Ohio within the service area.

 

SECTION 2. That the provisions of the existing Uniform Water and Supply Agreement not otherwise changed by this amendment shall remain in full force and effect.

 

                     SECTION 3. That the Ordinance is declared to be an emergency measure and shall take effect and be in force from and after its passage. The reason for the emergency lies in the fact that this Ordinance is necessary for the immediate preservation of the public peace, health, safety and property, and for the further reason that this Ordinance must be immediately effective in order to allow for the provision of water services to a new customer in the expanded service area.

 

     Vote on emergency clause:  yeas 12, nays 0.

 

     Passed:  February 1, 2022, as an emergency measure:  yeas 12, nays 0.
