Title

Amending and supplementing Title Seven of Part One of the Toledo Municipal Code and enacting a new Chapter 183 to create the Municipal Golf Preservation and Engagement Commission; and declaring an emergency.

SUMMARY & BACKGROUND:

The utilization and maintenance of City of Toledo owned municipal golf courses are a matter of concern.  It is important that citizens become involved and participate in decisions affecting how the City of Toledo owned golf courses are operated.  The passage of this Ordinance will establish the Municipal Golf Preservation and Engagement Commission to assist the City of Toledo and the Division of Parks, Recreation and Community Enrichment in operating the golf courses in a competent manner.

 

Summary

NOW, THEREFORE, Be it ordained by the Council of the City of Toledo:

 

                     SECTION 1.  That Title Seven of Part One of the Toledo Municipal Code is amended and supplemented by enacting a new Chapter 183 to read as follows:

 

Chapter 183

Municipal Golf Preservation and Engagement Commission

 

                     183.01  Commission created.

                     There is hereby created the Municipal Golf Preservation and Engagement Commission, which shall consist of not less than five (5) nor more than fifteen (15) members who shall serve without compensation. 

 

                     183.02  Membership.

The members of the Municipal Golf Preservation and Engagement Commission shall be nominated by the Mayor, subject to the confirmation by a majority vote of the City Council, and all of the members shall have voting power.

 

                     183.03  Terms of members.

The term of office of the members shall be three years, except that the initial members appointed by the Mayor shall be appointed for staggered terms of one, two or three years.  Members appointed to fill vacancies shall be appointed in the same manner for the remainder of the unexpired term of office. Any member may be reappointed by the Mayor to serve additional terms, subject to the approval by Council and the limitations imposed by Section 141.01 of the Toledo Municipal Code. All members shall hold office until their successors are duly appointed and qualified.

                     

                      183.04  Duties of the Commission. 

                     The Commission shall advise on the operation and preservation of city-owned municipal golf courses and will serve in an advisory capacity to the Mayor, City Council and the Commissioner of the Division of Parks, Recreation & Community Enrichment.  The Commission shall render periodic reports and recommendations to the Mayor, City Council and the Commissioner of the Division of Parks, Recreation & Community Enrichment. The Commission shall, when requested by Council, consider, investigate, make findings, report and recommend upon any special matter or questions coming within the scope of this work by:

(a.)                     Conducting annual golf course condition audits or assessments;

(b.)                     Reviewing contracts with golf course operators;

(c.)                     Working with community stakeholders to improve engagement of young people;

(d.)                     Offering insight into marketing and communications at our city-owned municipal golf courses; 

(e.)                     Assisting in the development of a History of Ottawa Park project; and

(f.)                     Assisting in the creation of the “Toledo Municipal Golf Hall of Fame.”

 

                     183.05  Organization and meetings.

The Commission shall elect its own President and such other officers as it deems necessary. The Commission may create from its members and/or persons who are not members, associate memberships and such committees and subcommittees as it shall deem necessary to carry out the function of the Commission. It shall prescribe its own rules of procedure and shall keep a record of its transactions and report annually to the Mayor and Council. It shall meet not less than once each month. The Commissioner of Parks, Recreation and Community Enrichment or their designated representative shall serve as an ex-officio member of the Commission.

 

183.06  Donations and gifts.

                        The Municipal Golf Preservation and Engagement Commission is hereby authorized to accept donations and gifts for the express purpose of defraying the costs incurred in its operations and duties. Any donations and gifts so received are to be deposited in the Golf Course Improvement Fund Account Code 2005-60300-5C13803STDSTD.

 

SECTION 2.                     That all formal actions concerning and relating to the passage of this Ordinance were passed in an open meeting of this Council, and that all deliberations of this Council and any of its committees that resulted in such formal action were in meetings open to the public, in compliance with all legal requirements including Section 121.22 of the Ohio Revised Code.

 

                     SECTION 3.  That this Ordinance is declared to be an emergency measure and shall take effect and be in force from and after its passage.  The reason for this emergency lies in the fact that this Ordinance is necessary for the immediate preservation of the public peace, healthy, safety and property and for the further reason in order to obtain citizens’ participation toward the goal of operating and maintaining city-owned municipal golf courses in a quality manner.
