Title
Authorizing the Mayor to accept and deposit Lead Based Paint Hazard Control (LBPHC) Program Income dollars derived from the recapture of project funds and miscellaneous reimbursements into the Lead Based Paint Hazard Control Grant Fund; authorizing the appropriation and expenditure of LBPHC program income to the LBPHC Grants Fund; authorizing the appropriation of the program income funds into the LBPHC Fund; authorizing the transfer of LBPHC program income from the unappropriated balance of the LBPHC Fund into the LBPHC Fund; authorizing the appropriation and expenditure of said funds for the LBPHC program; and declaring an emergency.

SUMMARY & BACKGROUND:
This legislation authorizes the acceptance, deposit and expenditure of LBPHC Program Income, and the re-appropriation and expenditure of LBPHC Program Income to be utilized within the LBPHC program. The LBPHC Program regulations require that all income derived from the recapture of project funds and miscellaneous reimbursements must be utilized for the LBPHC program. This Ordinance authorizes the use of those program income funds for the LBPHC program as required by HUD.
Summary
NOW, THEREFORE, Be it ordained by the Council of the City of Toledo:
SECTION 1. That the Mayor is authorized to accept and deposit LBPHC program income derived from the recaptured of project funds as authorized in the LBPHC Grant Agreement into Account Code 2016-16200-408990-GL7007STDLBP.
SECTION 2. That the unappropriated LBPHC program income funds are authorized to be appropriated in Fund 2016, Account 2016-16200-408990-GL7007STDLBP.
SECTION 3. That the LBPHC program income funds are appropriated to Fund 2016, LBPHC Fund, Account Code 2016-16200-GL7007STDLBP and said funds are authorized for expenditure for the LBPHC program per HUD regulations.
