Title

Amending Ordinance 393-21 by repealing Sections 2 and 4 and enacting a new Sections 2 and 4; and declaring an emergency.

SUMMARY & BACKGROUND:

Ordinance 393-21 authorized entering into a grant agreement with Ohio EPA with half of funds received to be used for tire collection/amnesty events. However, it was not included the requirement for the City of Toledo to collect at minimum $0.50/tire that should then be used to help fund future tire amnesty and collection events. After discussion with OEPA they agreed to waive the required collection fee for 2021 but requested we accept any donations and use those to fund future events. To be eligible to use any remaining grant funds related to the Tire Amnesty portion of the grant in 2022 the City of Toledo will be required to collect at minimum $0.50/tire at those events.

Summary

NOW, THEREFORE, Be it ordained by the Council of the City of Toledo:

 

                     SECTION 1. That Section 2 of Ordinance 393-21, which reads as follows:

                     

                     SECTION 2. That the mayor is authorized to accept and deposit grant proceeds in an amount not to exceed $64,000 into the Operation Grants Fund, Account Code 2016-38000-6G10226STDSTD for the purpose of completing work necessary to carry out the terms of this grant.

 

is repealed.

 

                     SECTION 2. That a new Section 2 of Ordinance 393-21 is enacted to read as follows:

 

                     SECTION 2. That the mayor is authorized to accept and deposit grant proceeds in an amount not to exceed $64,000 into the Operation Grants Fund, Account Code 2016-38000-6G10226STDSTD and any citizen donations in 2021 or fees charged in 2022 into the Storm Water Utility Improvement Fund Account Code 607B-38000-4UC1021STDSTD for the purpose of completing work necessary to carry out the terms of this grant.

 

                     SECTION 3. That Section 4 of Ordinance 393-21, which reads as follows:

 

                     SECTION 4. That the appropriation of an amount not to exceed $16,000 is authorized from the unappropriated fund balance of the Storm Water Utility Improvement Fund Account Code 607B-38000-4UC1021STDSTD and the expenditure of the same is authorized for the Engage Toledo Drop-Off Refuse & Recycling Events.

                     SECTION 4. That a new Section 4 of Ordinance 393-21 is enacted to read as follows:

 

                     SECTION 4. That the appropriation of an amount not to exceed $16,000 is authorized from the unappropriated fund balance of the Storm Water Utility Improvement Fund Account Code 607B-38000-4UC1021STDSTD and the appropriation of the amount equal to that of all donations or fees collected the expenditure of the same is authorized for the Engage Toledo Drop-Off Refuse & Recycling Events.

 

SECTION 5. That this Ordinance is declared to be an emergency and shall be in force and effect from and after its passage. The reason for the emergency lies in the fact that this Ordinance is necessary for the immediate preservation of the public peace, health, safety, and property of the city and for the further reason that the Ordinance must be immediately effective in order to satisfy the grant requirements.
