SUMMARY & BACKGROUND:

The City of Toledo has been awarded funding and is invited to enter into a grant agreement with the Environmental Protection Agency (EPA) for a Section 319(h) Grant in the amount of $299,610 to be used for the Bandore Park Stream Restoration Project. This ordinance authorizes the mayor to accept, deposit, appropriate and expend up to $299,610 in grant proceeds from the EPA.

Summary

NOW, THEREFORE, Be it ordained by the Council of the City of Toledo:

 

                     SECTION 1.                      That the mayor is authorized to enter into a grant agreement with the Environmental Protection Agency for the Bandore Park Stream Restoration Project upon terms and conditions acceptable to the Director of Public Utilities and the Director of Law.

 

SECTION 2.                      That the mayor is authorized to accept and deposit grant proceeds from the Environmental Protection Agency in an amount not to exceed $299,610 into the Operation Grants Fund, Account Code 2016-38000-6G00308STDSTD, for the purpose of completing work necessary to administer the grant authorized in Section 1.

 

SECTION 3.                      That the appropriation from the unappropriated grant proceeds in an amount not to exceed $299,610 is authorized from the Operation Grants Fund into Account Code 2016-38000-6G00308STDSTD; and further authorizing the expenditure of same for the Bandore Park Stream Restoration Project.

 

                     SECTION 4.                      That the mayor is authorized to accept bids and execute necessary contracts related to this grant upon such terms and conditions as shall be approved by the Director of Public Utilities and the Director of Law.

 

SECTION 5.                      That the Director of Finance is authorized to issue warrant or warrants against the account codes above in amounts not to exceed those authorized above in payment of the obligations incurred pursuant to the above-authorized contracts upon presentation of proper voucher or vouchers.  

                     

SECTION 6.                      That this Ordinance is declared to be an emergency and shall be in force and effect from and after its passage. The reason for the emergency lies in the fact that this Ordinance is necessary for the immediate preservation of the public peace, health, safety and property of the city and for the further reason that this Ordinance must be immediately effective in order to implement this program within the Environmental Protection Agency’s designated time schedule.
