SUMMARY & BACKGROUND:

As part of the 2013-2014 Consumer and Urban Horticulture Program, the City of Toledo, along with State of Ohio and Lucas County officials, entered into an Agreement with The Ohio State University Extension Service, authorized by Ordinance 79-13, to identify, map out, and spray areas affected by the Gypsy Moth. The City of Toledo would like to continue this Agreement for 2021-2022 program years with Ohio State University Extension.  The Extension will continue to provide telephone and email consultation to City of Toledo residents, provide research-based information on a variety of topics, conduct free educational programs, confirm gypsy moth and other invasive species infestations, and recommend suppression spraying if necessary.  This program also provides valuable informational services to the inquiring public regarding the health, disposition, and risk assessment of trees living on private property, growing and harvesting food, and pesticide information and their organic alternatives. The City of Toledo will pay annual installments up to $27,000 for the program.  Funds for this expenditure are included in the FY2021 General Fund Budget for the Department of Public Service, Parks, Recreation and Forestry Division.

Summary

NOW, THEREFORE, Be it ordained by the Council of the City of Toledo:

 

SECTION 1.  That the Mayor is authorized to enter into a two-year Agreement with the Ohio State University Extension Service and/or Lucas County to promote and sponsor an Urban Horticulture Education Program, including Gypsy Moth suppression and management.

 

SECTION 2. That this Council finds and determines it is in the best interest of the City to waive the competitive procurement requirements of Toledo Municipal Code Chapter 187 for the reason that the Ohio State University Extension Service is particularly suited for these services and intergovernmental agreements are authorized under Ohio Revised Code Section 307.15.

 

SECTION 3.  That an expenditure in an amount not to exceed $27,000 annually over the life of the Agreement is authorized from the General Fund, Account Code 1001-60500-2000312STDSTD for payment to Ohio State University Extension Service or their designee, subject to future appropriations.

 

SECTION 4.  That the Finance Director is authorized to issue warrant or warrants against the above-mentioned Account Code in an amount not to exceed $27,000 per year, in payment of the obligations authorized above upon presentation of proper voucher or vouchers.

 

 SECTION 5.  That this Ordinance is declared to be an emergency measure and shall take effect and be in force from and after its passage.  The reason for the emergency lies in the fact that this Ordinance is necessary for the immediate preservation of the public peace, health, safety, and property and so that these projects can be initiated as soon as possible for the timely dissemination of public information regarding tree and garden health and for the seasonal control of gypsy moths from Toledo’s urban forests.
