Authorizing the appropriation and expenditure of $37,300 from the General Fund for emergency repairs to the building located at 117 Main Street Toledo, Ohio; authorizing the mayor to enter into an agreement with My Great Escape, LLC; authorizing the certification and assessment of nuisance abatement costs to the property owner(s); waiving the competitive procurement requirements of the TMC 187; and declaring an emergency.

SUMMARY & BACKGROUND:

On August 9, 2021 an Unsafe Building/ Emergency Condition -Vacate Order was issued to the Freedman Management Co. LLC concerning an unsafe building with serious hazards known as the Freedman Building 117 Main Street Toledo, OH, parcel No. 1702754.  Due to the owner’s lack of progress in addressing the Unsafe Building and Emergency Conditions the City of Toledo accepted a proposal from My Great Escape, LLC to stabilize the structure as an emergency project to protect public safety. The proposal is estimated not to exceed $37,300 dollars.

 

The cost of the stabilization project as well as the City of Toledo cost to secure the emergency site will be certified and assessed to the property owner(s) in compliance with ORC 715.261.

 

The fiscal impact of this ordinance is as follows:

Summary

NOW, THEREFORE, Be it ordained by the Council of the City of Toledo:

 

                     SECTION 1.  That the appropriation of $37,300 is authorized from the unappropriated balance of the General Fund to Account Code 1001-56300-5652001STDSTD and the expenditure of same is authorized for emergency repairs to the building located at 117 Main Street Toledo, Ohio Parcel No. 1702754.

                     

                     SECTION 2.                      That the Mayor is authorized to enter into an agreement with My Great Escape, LLC for the purpose listed in Section 1 upon such terms and conditions as approved by the Director of Neighborhoods and the Director of Law.

 

                     SECTION 3.  That City Council finds and determines that it is in the best interest of the City that the competitive procurement requirements of Toledo Municipal Code Chapter 187 are waived for the reason that the emergency repairs to the building located at 117 Main Street Toledo, Ohio are immediately necessary to maintain public safety.

 

                     SECTION 4.                     That City Council finds that it is in the best interest of the city to certify the costs of the emergency repairs to the building at 117 Main Street Toledo, Ohio as well as the City of Toledo’s costs to secure the emergency project site to property owner(s) property tax invoice for 2022.

 

                     SECTION 5.                       That the Director of Finance is authorized to issue warrant or warrants against the account code listed in Section 1 above in an amount not to exceed $37,300 in payment of the above-authorized obligations upon presentation of the proper voucher or vouchers.

 

                     SECTION 6.  That this Ordinance is declared to be an emergency measure and shall take effect and be in force immediately from and after its passage. The reason for the emergency lies in the fact that this Ordinance is necessary for the immediate preservation of the public peace, health, safety and property, and for the further reason that this Ordinance must be immediately effective in order to reimburse the contractors for the emergency work at 117 Main Street Toledo, Ohio.
