Title

Authorizing the Mayor to execute, deliver and accept needed instruments for the conveyance and acquisition of real property from FSC BGL Toledo Ohio, LLC for the realignment, reconstruction and improvement of a portion of Campbell Street; dedicating the same as public right-of-way; and declaring an emergency.

SUMMARY & BACKGROUND:

The City of Toledo is proceeding with the reconstruction of Campbell Street between Pulaski Street and Hoag Street.  There is currently a somewhat dangerous “s”-style curve in the roadway of Campbell Street at Junction Avenue, which needs to be realigned so that there is a smoother and less dangerous transition in the alignment of the road. 

 

FSC BGL Toledo Ohio, LLC is the fee owner of a certain parcel of land located at 1411 Campbell Street (TD Parcel 18-02801).  FCS BGL Toledo Ohio, LLC has agreed to convey 0.0424 acres of land to the City of Toledo necessary for the realignment of Campbell Street at Junction Avenue, at no cost. This land needs to be dedicated for public highway and roadway purposes, including but not limited to utilities, sewers and pedestrian improvements.

This ordinance does not require the City to expend or receive funds.

Summary

NOW, THEREFORE, Be it ordained by the Council of the City of Toledo:

 

SECTION 1.                     That the Mayor is authorized to execute, deliver and accept needed instruments for the conveyance and acquisition of a 0.0424-acre parcel of real property from FSC BGL Toledo Ohio, LLC which is more fully described in Exhibit A attached hereto and made a part hereof by reference.

 

SECTION 2.                     That the parcel of land described in Section 1 herein be and the same are hereby dedicated for public right-of-way purposes, including but not limited to roads, utilities and sewers.

 

                     SECTION 3.                     That the Department of Public Utilities, Real Estate Section, is hereby directed to cause a copy of needed instruments to be recorded in the records of the Lucas County Recorder.

 

                     SECTION 4.                     That it is hereby found and determined that all formal actions of Council concerning and relating to the passage of this Ordinance were adopted in an open meeting of Council, and that all deliberations of Council and any of its committees that result in such formal action were in meetings open to the public in compliance with all legal requirements, including Section 121.22 of the Ohio Revised Code.

 

SECTION 5.                     That this Ordinance is hereby declared to be an emergency measure and shall take effect and be in force immediately from and after its passage.  The reason for the emergency lies in the fact that the same is necessary for the immediate preservation of the public peace, health, safety and property and for the further reason that this Ordinance must be immediately effective in order to proceed with the reconstruction of Campbell Street at the earliest possible date.
