Title

Authorizing the settlement of AT&T Ohio’s claim against the City of Toledo for property damage in the amount of $37,820.00; and authorizing the expenditure of $37,820.00 from the Risk Management Fund; and declaring an emergency.

SUMMARY & BACKGROUND:

City of Toledo Water Distribution personnel working in the area between 5511 and 5435 Douglas Road, Toledo, Ohio on September 4, 2019 cut AT&T’s underground fiber optic duct and cables. Settlement of the claim has been reached in the amount of $37,820.00.

 

Summary

NOW, THEREFORE, Be it ordained by the Council of the City of Toledo:

 

                     SECTION 1.  That the payment of $$37,820.00 in settlement of the claim of AT&T is hereby approved.

 

                     SECTION 2.  That the payment of this claim is contingent upon the execution of the proper release by AT&T.

 

                     SECTION 3.  That the Director of Finance is hereby authorized and directed to draw his warrant or warrants to Ameritech in the sum of $37,820.00 against Account Code No. 7095/12000/1157001STDSTD upon presentation of the proper voucher therefore.

 

                     SECTION 4.  That this Ordinance, being an emergency measure, shall be in force and effect from and after its passage. The reason for the emergency lies in the fact that this Ordinance is necessary for the immediate preservation of the public peace, health, safety and property, and for the further reason that this Ordinance must be immediately effective in order to implement the settlement in accordance with the conditional agreement of the Administration.
