Title
Repealing and replacing Section 3 of Ordinance 364-20; and declaring an emergency.

SUMMARY & BACKGROUND:
This Ordinance repeals Section 3 of Ordinance 364-20 and replaces it with a new Section 3. Ordinance 364-20 authorized the project appropriations for the Automated Meter Reading (AMR)/Advanced Metering Infrastructure (AMI) and Leak Detection System project at the Department of Public Utilities. This ordinance amends the appropriation of funds to adjust the allocation between the Water and Sewer Utilities to align with the 2020 water bond issuance cost allocation certificate. This does not increase the total amount of the project or change the scope of the project.
Summary
NOW, THEREFORE, Be it ordained by the Council of the City of Toledo:
SECTION 1. That Section 3 of Ordinance 364-20 that reads as follows:
“That the appropriation in an amount not to exceed $38,897,291 is authorized from the unappropriated bond proceeds in the Water Bond Improvement Fund to Account Code 6062-31000-4UB1918STDSTD and an amount not to exceed $38,892,844 is authorized from the unappropriated bond proceeds in the Sewer Bond Improvement Fund to Account Code 6072-31000-4UB1918STDSTD for said AMI project; and the expenditure of the same is authorized.”

SECTION 2. That a new Section 3 of Ordinance 364-20 is enacted to read as follows:
“That the appropriation in an amount not to exceed $41,145,135 is authorized from the unappropriated bond proceeds in the Water Bond Improvement Fund to Account Code 6062-31000-4UB1918STDSTD and an amount not to exceed $36,645,000 is authorized from the unappropriated bond proceeds in the Sewer Bond Improvement Fund to Account Code 6072-31000-4UB1918STDSTD for said AMI project; and the expenditure of the same is authorized.”
SECTION 3. That all other Sections of Ordinance 364-20 remain in full force and effect.
SECTION 4. That this Ordinance is declared to be an emergency measure and shall take effect and be in force immediately from and after its passage. The reason for the emergency lies in the fact that this ordinance is necessary for the immediate preservation of the public peace, health, safety and property and for the further reason that this ordinance must be immediately effective in order to maintain safe, reliable water service.
