SUMMARY & BACKGROUND:

Pursuant to the removal of two other elevated walkways along with written support and approval for the demolition of the Bridge Concourse has been received from Continental Real Estate Companies and FIS 3 LLC, successors in interest respectively to Toledo Convention Hotel Company, Limited Partnership and TOLEX II Limited Partnership as owners of the properties connecting to Bridge Concourse, the City is authorized to move forward with the reconstruction of Summit Street from Lafayette Street to Jackson Boulevard. 

 

In fitting with the new streetscape of Summit Street, it is necessary that the overhead pedestrian concourse connecting to the buildings located at 101 and 102 N. Summit (the “Bridge Concourse”) be removed.

 

This ordinance authorizes the closure and demolition of the Bridge Concourse. 

 

The fiscal impact of this ordinance is as follows:

Summary

NOW, THEREFORE, Be it ordained by the Council of the City of Toledo:

 

SECTION 1.  That the elevated public pedestrian concourse over Summit St. connecting 102 N Summit and 101 N Summit (the “Bridge Concourse”) is hereby closed.

 

SECTION 2. That the physical structure of Elevated Concourse is authorized for removal/demolition.

 

SECTION 3. That the Mayor is authorized to accept bids and award contracts, for the purposes for the purposes specified in Section 1and 2.

 

SECTION 4. That an expenditure is authorized in an amount not to exceed $400,000 from Capital Improvement Program Fund Account Code 5040-26100-8CP2113SMMTWW for demolition of the Elevated Concourse.

 

SECTION 5. That the Director of Finance is authorized to issue her warrant or warrants against the account code listed in Section 4 in an amount not to exceed $400,000 in payment of the above authorized obligations upon presentation of the proper voucher or vouchers.

 

SECTION 6.  That the Commissioner of Transportation may erect such signs and/or barricades which the Commissioner deems necessary to carry out this closure and allow such temporary closures of adjacent rights-of-way, all as may be prudent for public safety and in the best interest of the city.

 

SECTION 7.  That the mayor and other appropriate city officers are authorized to execute such agreements, documents or instruments, and take such other actions, as deemed necessary by the Director of Law to amend, terminate and discharge concourse and/or easement agreements related to the Bridge Concourse as recorded in Lucas County Records.

 

SECTION 8.  That the closure authorized by this Ordinance be properly recorded in the appropriate public record.

 

SECTION 9. That the City of Toledo reserves exclusive control over access to the rights-of-way over Summit St. at this location.

 

SECTION 10.  That this Ordinance is declared to be an emergency measure and shall be in force and take effect from and after its passage.  The reason for the emergency lies in the fact that the same is necessary for the immediate preservation of the public peace, health, safety and property, and for the further reason that the Ordinance must be immediately effective to carry out the public purpose of encouraging cultural, educational, and downtown redevelopment opportunities in the City of Toledo, and to enable the redevelopment of the Fort Industry Square and Park Inn projects to move forward.
