SUMMARY & BACKGROUND:

This Ordinance authorizes an agreement between Toledo Municipal Court (“TMC”) and the Lucas County Board of County Commissioners for the provision of electronic monitoring of criminal defendants in the Toledo Municipal Court. The Agreement is for a one-year term with an option to extend the agreement for an additional two years.

 

Summary

NOW, THEREFORE, Be it ordained by the Council of the City of Toledo:

 

                     SECTION 1. The Mayor, the Municipal Court Judges, and the Municipal Court Administrator are authorized to enter into an agreement for a one-year term, with two one-year renewal options with the Lucas County Board of Commissioners for the provision of electronic monitoring services.

 

SECTION 2.  The competitive procurement requirements under Toledo Municipal Code Chapter 187 are waived as it is found and determined that contracting with Lucas County is a cost effective and the most secure manner to obtain the needed electronic monitoring services.

 

                     SECTION 3. That the expenditure of an amount not to exceed $332,150 annually over the life of the agreement is authorized from the General Fund, Account Code 1001-10800-3000257STDSTD, subject to future appropriations, for the services authorized in Section 1.

 

                     SECTION 4.  The Finance Director is authorized to draw his warrant or warrants against the above referenced account code in payment of the above obligations upon presentation of proper voucher or vouchers.

 

                     SECTION 5.  This Ordinance is declared to be an emergency measure and shall be in force and effect from and after its passage.  The reason for the emergency lies in the fact that same is necessary for the immediate preservation of the public peace, health, safety, and property and for the further reason that the Ordinance must be immediately effective in order to provide necessary electronic monitoring of criminal defendants.
