SUMMARY & BACKGROUND:

The City of Toledo’s Woodlot operation utilizes a wood recycling machine to process thousands of pounds of trees, brush, and fallen or trimmed tree limbs each year. This product is then resold, producing revenue that is used to invest back into the health of the city’s tree canopy.  The current wood recycling machine is long past its useful life, breaks down frequently, and repairs are beginning to exceed the machine’s value. Parks, Recreation and Forestry would like to proceed with a purchase of a new wood recycling machine through Bandit Industries, Inc., who currently holds the state term contract. Bandit will allow us to trade in our current machine for a purchase credit of $160,000 which is equivalent to its fair market value. Replacing the recycler will facilitate the continued woodlot grinding operations.

 

The fiscal impact of this ordinance is as follows:

Summary

NOW THEREFORE, Be it ordained by the Council of the City of Toledo:

 

SECTION 1.  That the Mayor is authorized to enter into contract with Bandit Industries, Inc. for the purchase of a new wood recycling machine for the city woodlot operations.

 

SECTION 2. That the amount of up to $675,000 is authorized for expenditure from the Capital Improvement Fund account Code 5040 - 60500 - 8CP2137WOODGR for the purchase of a new wood recycling machine.

 

SECTION 3.  That the Council finds it is in the best interest of the city to waive competitive procurement and disposal provisions of the Toledo Municipal Code chapter 187 for the reason that Bandit Industries, Inc. has offered to sell the new equipment at a price equal to that of the state term contract and has offered a trade-in purchase credit in an amount equal to the prevailing market rate of the used equipment.

 

                     SECTION 4.  That the Finance Director is authorized to draw his warrant or warrants against the accounting code in Section 1 above, in payment of the above obligations authorized upon presentation of the proper voucher or vouchers.

 

SECTION 5.  That this Ordinance, being an emergency measure, shall take effect and be in force from and after its passage. The reason for the emergency lies in the fact that the Ordinance is necessary for the immediate preservation of the public peace, health, safety, and property and to facilitate the continued woodlot grinding operations.
