Repealing Section 521.12(f) of the Toledo Municipal Code regarding face coverings and enacting a new Section 521.12(f); and declaring an emergency.

SUMMARY & BACKGROUND:

Chapter 521 of the Toledo Municipal Code was approved by Toledo City Council on July 13, 2020, in response to the COVID-19 pandemic, requiring face coverings during the pendency of a state or locally declared state of emergency for a health-related reason. There have been several amendments to state orders regarding face coverings and the state of emergency since that time. It is the intention of Council that the authority to determine whether Chapter 521 is effective during a health-related state of emergency shall be vested in the Mayor.

 

Summary

NOW, THEREFORE, Be it ordained by the Council of the City of Toledo:

 

                     SECTION 1.                     That Toledo Municipal Code Section 521.12(f), which reads as follows, is hereby repealed:

(f)                     This section 521.12 is effective only during the pendency of a state or locally declared state of emergency for a health related reason.

 

SECTION 2. That a new Toledo Municipal Code Section 521.12(f) is hereby enacted as follows:

(f)                     This section 521.12 is effective only during the pendency of a state or locally declared state of emergency for a health-related reason where the Mayor has declared it necessary in order to preserve the public safety and health of the community.

 

SECTION 3.                     It is found and determined that all formal actions of this Council concerning and relating to the passage of this Ordinance were passed in an open meeting of this Council, and that all deliberations of this Council and any of its committees that resulted in such formal action, were in meetings open to the public, in compliance with all legal requirements including Section 121.22 of the Ohio Revised Code.

 

                     SECTION 4.  That this Ordinance is declared to be an emergency measure and shall take effect and be in force immediately from and after its passage.  The reason for the emergency lies in the fact that the same is necessary for the immediate preservation of the public peace, health, safety and property, and for the further reason that this legislation is needed to clarify when this ordinance shall be effective.
