SUMMARY & BACKGROUND:
The City of Toledo has been awarded funding and is invited to enter into a grant agreement with the Functional Litter-acy: Trash Trappers for a Cleaner Toledo Project. The acceptance of grant proceeds and the authorization to expend those grant proceeds to fiscally support this ordinance was approved by Ord. 334-20.
This ordinance requests authorization to enter into agreements with the University of Toledo for research efforts about the captured trash and Partners for Clean Streams for related community education efforts.
The University of Toledo (UToledo) is a national, public research university where students obtain a world class education and become part of a diverse community of leaders committed to improving the human condition in the region and the world. UToledo students will characterize the debris collected at the sites during the project period in accordance with established NOAA trash classification protocols (quantity, types, and concentration). This information will be used to inform future public education initiatives and to guide planning for trash collection device implementation and maintenance in the City of Toledo.
Partners for Clean Streams (PCS), a 501(c3) not-for-profit, has extensive experience building partnerships, leading community-based efforts, undertaking marine debris removals, and managing grants successfully. PCS will recruit, train, and oversee volunteers removing the debris by hand from river banks, in the water and from nearshore areas along the areas where trash traps are installed, and coordinate the public outreach and involvement throughout the project.

Summary
NOW, THEREFORE, Be it ordained by the Council of the City of Toledo:
SECTION 1. That the mayor is authorized to enter into an agreement with the University of Toledo for $45,118 for captured trash research efforts related to the Functional Litter-acy: Trash Trappers for a Cleaner Toledo Project and an agreement with Partners for Clean Streams for $20,000 for the purpose of related community outreach and education.
SECTION 2. That this City Council finds and determines it is in the best interest of the City to waive the competitive procurement requirements of TMC Chapter 187 for the reason that it is in the best interest of the City of Toledo to contract with the University of Toledo and Partners for Clean Streams as these entities are recognized industry leaders and have been approved by the grant provider, the Environmental Protection Agency.
SECTION 3. That this Ordinance is declared to be an emergency and shall be in force and effect from and after its passage. The reason for the emergency lies in the fact that this ordinance is necessary for the immediate preservation of the public peace, health, safety and property of the city and for the further reason that this Ordinance must be immediately effective in order to implement this program within the Environmental Protection Agency’s designated time schedule.
