SUMMARY & BACKGROUND:

Petitioner has filed a request to vacate a portion of the Jackson Street and Adams Street right of way, in Toledo, Lucas County Ohio.

 

Summary

NOW, THEREFORE, Be it resolved by the Council of the City of Toledo:

 

                     SECTION 1.  That the City Council does hereby declare its intent to vacate right of way further described below:

 

Vacating of Adams & Jackson Street Right of Ways

LEGAL DESCRIPTION

Being part of the West 90 acres of the Northwest Quarter of Section 36, Town 9 South, Range 7 East adjacent to lot 21 in Philip's Addition as recorded in Plat Vol. 2A, Pg. 31 in Lucas County Plat records, and being Part of the existing Jackson Street and Adams Street Right of Ways, all in the City of Toledo, Lucas county, Ohio and being more particularly described as follows:

Commencing at a found Monument box containing stone with a drill hole at the intersection of Adams Street and Ontario Street.

Thence, N 56° 51’ 31” W, on and along the centerline of Adams Street (66 feet wide), a distance of 1,954.42 feet to a point;

Thence, N 33° 08’ 29” E, a distance of 26.00 feet to the “Point of Beginning”;

Thence, N 56° 51’ 31” W, a distance of 121.14 feet to a point;

Thence, N 00° 55’ 41” W, a distance of 19.28 feet to a point;

Thence, N 89° 08’ 26” E, a distance of 151.31 feet to a point;

Thence, S 00° 55’ 41” E, a distance of 11.80 feet to a point on the south Right of Way line of Jackson Street (60 feet wide);

Thence, N 89° 04’ 19” W on and along the south Right of Way line of Jackson Street, a distance of 113.19 feet to a point at the southerly extension of the East Right of Way line of Vermont Avenue (60 feet wide);

Thence, S 00° 56’ 50” E on and along the southerly extension of the East Right of Way line of Vermont Avenue, a distance of 24.63 feet to a point at the Northeasterly Right of Way line of Adams Street;

Thence, S 56° 51’ 31” E on and along the Northeasterly Right of Way line of Adams Street, a distance of 79.84 feet to a point;

Thence, S 33° 08’ 29” W, a distance of 7.00 feet to the “Point of Beginning”;

The area herein described contains 3,111.24 square feet ~ 0.071 acres of land, more or less and is part of Adams Street and Jackson Street Right of Ways.

Subject to all legal highways, leases, easements, restrictions and agreements of record.

NOTES:

1. Coordinate system/basis of bearings:

Determined by the Ohio State Plane coordinate system North Zone (3401) NAD 83 (2011) 2002.0 epoch, units in U.S. survey feet, obtained using GPS equipment and the Ohio Department of Transportation VRS/RTK network.

Bearings used are for the express purpose of showing angular measurement only.

 

                     SECTION 2.  That this matter be referred to the Toledo City Plan Commission for its review, recommendation and appropriate hearing date.

 

                     SECTION 3.  That this Resolution hereby is declared to be an emergency measure and shall be in force and effect from and after its adoption.  The reason for the emergency lies in the fact that same is necessary for the immediate preservation of the public peace, health, safety and property, and for the further reason that this Resolution must be immediately effective so that the vacation can be expeditiously completed to enable property owners to obtain the resulting benefits at the earliest time.
