SUMMARY & BACKGROUND:

Pursuant to the authority of Ordinances 442-12 and 336-14, and 238-16 the City entered into successor Memorandums of Understanding (MOU’s) with the Lucas County Land Reutilization Corporation (LCLRC), also known as the Lucas County Land Bank, to allow the Department of Inspection, the Department of Public Service and the Department of Public Utilities to provide demolition and maintenance services to the acquired blighted LCLRC properties within the City of Toledo, and to govern other matters between the City and LCLRC. A new updated MOU with the LCLRC is required to utilize current available program funds within the City of Toledo.  This Ordinance authorizes the City to enter into a new, updated, and grant compliant MOU with the LCLRC. The new MOU will replace all prior MOU’s entered into with the LCLRC.  This ordinance further authorizes the one-time expenditure of $30,000 to the LCLRC to acquire a software license which will allow the City to utilize the Land Acquisition Information Network developed by the LCLRC as a tool to better manage the City’s acquisition inventory and management needs of land held by the City as part of the City’s land bank process.

Summary

NOW, THEREFORE, Be it ordained by the Council of the City of Toledo:

 

SECTION 1.  That the Mayor is authorized to enter into a Memorandum of Understanding with the Lucas County Land Reutilization Corporation to provide inspections, to terminate water and sewer service, to demolish and to maintain and manage blighted structures and lots acquired by Lucas County Land Reutilization Corporation within the City of Toledo. 

 

SECTION 2.                       That the Mayor and Director of Finance are authorized to receive, deposit, appropriate and expend funds from the Demolition Trust as needed to perform the demolition and maintenance services required in furtherance of the Memorandum of Understanding, and award and execute contracts to procure the necessary equipment and supplies.

 

SECTION 3.  That a minimum amount of $250,000 is authorized to be accepted from the Lucas County Land Reutilization Corporation and deposited into the General Fund to account code 1001-60500-7000301STDSTD for property mowing.

 

SECTION 4.                     That the Mayor is authorized to enter into a software license agreement with the Lucas County Land Reutilization Corporation for the Land Acquisition Land Network (LAIN) software and the expenditure of $30,000 is authorized from the Capital Improvement Fund Account Code 5040-17500-8CP2107EDLANE for said purpose.

 

SECTION 5.  That Council finds and determines that with respect to the software license acquisition it is in the best interest of the City to waive the competitive procurement provisions of Toledo Municipal Code Chapter 187 considering the LAIN software is software developed by and solely sourced from the Land Bank and readily customizable to serve contemporaneously the Land Bank’s and the City’s real estate common land inventory management needs.

 

SECTION 6.  That the appropriation of $917,799 is authorized from the unappropriated balance of the General Fund to Account Code 1001-56400-537575-5634001STDSTD and the expenditure of same combined with $366,667 previously appropriated under Account Code 1001-56400-537575-5634001STDSTD is authorized to reimburse the Demolition Trust Fund Account Code 2090-23100-5T12211STDDEM for demolition costs incurred in prior years.

 

SECTION 7.   That this Ordinance is declared to be an emergency measure and shall take effect and be enforced from and after its passage.  The reason for the emergency lies in the fact that this Ordinance is necessary for the immediate preservation and safety of the neighborhood surrounding the vacant structures and properties acquired by the Lucas County Land Reutilization Corporation with the City of Toledo.
