SUMMARY & BACKGROUND:

This Ordinance authorizes the Mayor to enter into an agreement with the Toledo-Lucas County Health District in an amount not to exceed $200,000, for the purpose of enforcement and duties related to Ch. 1760, Residential Rental Properties and Lead Safety Compliance.

 

On October 20, 2020, Toledo City Council passed Ordinance 397-20 that repealed and replaced Chapter 1760 of the Toledo Municipal Code and enacted Chapter 1760 Residential Rental Properties and Lead Safety Compliance, which requires certain rental properties and family child care homes be registered and certified “lead-safe” to prevent potential human exposure to lead hazards. Pursuant to Chapter 1760.01, all fees related to the issuance of lead-safe certificates or registration of local lead inspectors are to be deposited in the lead ordinance fund of the Toledo-Lucas County Health District to be used exclusively for the administration, implementation, and enforcement of Chapter 1760. Because said fees will not fully cover the Toledo-Lucas County Health District’s expenses, the City of Toledo wishes to support Chapter 1760’s successful implementation and enforcement efforts by providing funds for the Toledo-Lucas County Health District to perform their duties.

 

Summary

NOW, THEREFORE, Be it ordained by the Council of the City of Toledo:

 

SECTION 1.                     That no more than $200,000 that is assigned to account code 1001/16200/537410/5632005STDSTD for expenditure for payments to or on behalf of the Toledo-Lucas County Health District for expenses related to the implementation and enforcement of Chapter 1760 in excess of fees collected by the same.

 

SECTION 2.                     That the Director of Finance is authorized to draw their warrant or warrants against the Account Code in Section 1 in payment of the above authorized obligations in an amount not to exceed $200,000 upon presentation of the proper voucher or vouchers.

 

SECTION 3.                     That the Mayor is authorized to enter into all necessary agreements with the Toledo-Lucas County Health District in order to facilitate the purpose of this Ordinance upon such terms and conditions as approved by the Director of Law.

 

SECTION 4.                     That a condition of the agreement between the City and the Toledo-Lucas County Health District is that that all expenditures made under this Ordinance be used by the Health District to enact and enforce Chapter 1760 of the Toledo Municipal Code. Expenditures in excess of fees collected by the Toledo-Lucas County Health District may be reimbursed on a quarterly basis.

 

SECTION 5.                     That this Ordinance is declared to be an emergency measure and shall take effect and be in force from and after its passage. The reason for the emergency lies in the fact that the same is necessary for the immediate preservation of the public peace, health, safety and property, and for further reason that the Ordinance must be immediately effective in order to encourage property owners to make their properties lead-safe for children as soon as possible.
