SUMMARY & BACKGROUND:
The Broadway Corridor Coalition submitted a District Improvement Program application for the Old South End Gateway Arch Project in District 3. The proposal includes erecting a gateway arch over Broadway as cars and pedestrians enter the Old South End from the downtown Toledo area. The District Improvement Review Committee convened on January 7, 2021, and recommended approval of this application in an amount not to exceed $108,500.00.
Summary
NOW, THEREFORE, Be it ordained by the Council of the City of Toledo:
SECTION 1. That a sum not to exceed $108,500.00 is authorized for expenditure from Account Code 5040-16400-8CP1817DNGPRO for the District Improvement Program, Old South End Gateway Arch Project, as detailed in Attachment A.
SECTION 2. That the Mayor is authorized to execute the necessary contract(s) for the District Improvement Program, Old South End Gateway Arch Project upon such terms and conditions as shall be approved by the Director of the Department of Development, the Director of Public Service and the Director of Law.
SECTION 3. That the Director of Finance is authorized to draw warrant or warrants against the above account code in payment of the above authorized obligations in an amount not to exceed that authorized in Section 1 upon presentation of the proper voucher or vouchers.
SECTION 4. That this Council finds it in the best interest of the city to waive the formal competitive bidding requirements of TMC Chapter 187 for the reason that the applicant conducted an open bid process for construction. Four bids were received, and the bid submitted by the selected contractor was significantly lower than the other bids. See Attachment B.
SECTION 5. It is found and determined that all formal actions of this Council concerning and relating to the passage of this Ordinance were passed in an open meeting of this Council, and that all deliberations of this Council and any of its committees that resulted in such formal action, were in meetings open to the public, in compliance with all legal requirements including Section 121.22 of the Ohio Revised Code.
SECTION 6. That this Ordinance is declared to be an emergency measure and shall take effect and be in force from and after its passage. The reason for the emergency lies in the fact that the same is necessary for the immediate preservation of the public peace, health, safety and property and so that this project can be initiated as soon as possible for neighborhood development.
