Authorizing the mayor to execute a water agreement with the City of Oregon and Toledo Refining Company LLC for the purpose of establishing a specialized water rate.

SUMMARY & BACKGROUND:

The City of Toledo (“Toledo”) and the City of Oregon (“Oregon”) entered into an Agreement providing a specialized water rate to Clean Energy Future, LLC in 2017, via Ord. 186-17.  Toledo wishes now to provide this specialized rate to Toledo Refining Company LLC, which is geographically similar. 

 

All water will be metered.  Water provided to either municipality during an emergency will be metered and billed at the first block rate plus a 75% surcharge.  Water will be sold to Toledo Refining at a rate equal to 90% of the Second block rate as of the first day of the billing period with no surcharge.

 

This ordinance authorizes the mayor and the Directors of the Departments of Public Utilities and Law to execute a water agreement between Toledo, Oregon and Toledo Refining Company LLC.   

 

The fiscal impact of this ordinance is as follows:

Summary

NOW, THEREFORE, Be it ordained by the Council of the City of Toledo:

                                          

                     SECTION 1.  That the mayor is authorized to execute a water agreement between the City of Toledo, the City of Oregon and Toledo Refining Company LLC, substantially similar to the agreement authorized by Ord. 186-17. 

 

                     SECTION 2.  That, to the extent that said provisions may otherwise be applicable, Section 3 of Ordinance No. 582-10 and Section 3 of Ordinance No. 606-07 are waived. 

 

                     SECTION 3.  That the water agreement shall contain such other terms and conditions as the Directors of Law and Public Utilities deem to be in the best interest of the City of Toledo.

 

                     SECTION 4.  That this Ordinance shall take effect and be in force from and after the earliest date permitted by law.
