SUMMARY & BACKGROUND:

This ordinance seeks to authorize the Mayor to enter into an agreement with the Lucas County Board of Commissioners to contract for five beds at the Correctional Center of Northwest Ohio (CCNO) for the detention of city prisoners sentenced under the Toledo Municipal Code (TMC). The Toledo Municipal Court currently uses CCNO for those convicted under the Ohio Revised Code but city prisoners are sent to the Wood County jail pursuant to an agreement in which the City has contracted with Wood County for 10 jail beds. The per diem rate set is by CCNO annually and the City’s per bed cost will never exceed Lucas County’s per bed cost. The per diem rate for 2021 will be $71.85.  The one-year agreement renewable annually would begin January 1, 2021.

 

Summary

NOW, THEREFORE, Be it ordained by the Council of the City of Toledo:

 

                     SECTION 1. That the Mayor is authorized to execute the necessary documents to

enter into a one-year agreement with the Lucas County Board of Commissioners, renewable annually, for the use of five (5) beds at the Corrections Center of Northwest Ohio to house City Prisoners upon such terms as are acceptable to the Safety Director and Director of Law.

 

           SECTION 2.  That the expenditure of funds is authorized from the General Fund, Account Code 1001-51000-537480-3399001STDSTD for the purposes authorized in Section 1.

 

                     SECTION 3.                     That the Finance Director is authorized to draw a warrant or warrants against the Account Code above in payment of the obligations authorized above.

 

                     SECTION 4. That this Ordinance is declared to be an emergency measure and shall be in force and effect from and after its passage.  The reason for the emergency lies in the fact that it is necessary for the immediate preservation of the public peace, health, safety, and property and for further reason that the contractual authority is needed to insure provision of uninterrupted detention services for City Prisoners.
