SUMMARY & BACKGROUND:

It is the intent of this Ordinance to appropriate $1,000,000 from the Sewer Replacement Fund for the Division of Water Reclamation Dewatering System Rebuild Project. The existing equipment and systems are over 30 years of age and are beyond the intended service life. This project will address the complete rebuild of three Belt Filter Presses and associated equipment; some of which includes PLC cabinets, conveyors, feed pumps and polymer system, along with other ancillary systems. This work is necessary to maintain safe, reliable solids process as well as to maintain compliance with the NPDES discharge permit requirements, as set forth by the Ohio EPA.

Summary

NOW, THEREFORE, Be it ordained by the Council of the City of Toledo:

 

SECTION 1.                     That the appropriation in an amount not to exceed $1,000,000 is authorized from the Sewer Replacement Fund into Account Code 6073-36000-4UC1920STDSTD for the purchase of equipment and construction services necessary to facilitate the completion of the Dewatering System Rebuild Project at the Water Reclamation Plant; and further authorizing the expenditure of same.

 

SECTION 2.                     That the mayor is authorized to advertise, accept bids, and to execute agreements, contracts, and purchase orders for purchase of equipment and construction services necessary to facilitate the completion of the Dewatering System Rebuild Project at the Water Reclamation Plant, subject to approvals by the Director of Public Utilities and the Director of Law.

 

SECTION 3.                     That the mayor and the Director of Public Utilities are authorized to execute a contract with Alpha Laval for the rebuild of three Belt Filter Presses in the amount not to exceed $564,900.

 

SECTION 4. That this Council finds it in the best interest of the City to waive the competitive procurement requirements of TMC Chapter 187 for the reason that Alpha Laval is the only company that can supply the necessary parts and rebuild the existing three belt filter presses.

SECTION 5. That the Finance Director is authorized to issue her warrant or warrants against the account code identified in Section 1 above, in an amount not to exceed $1,000,000 in payment of the obligations authorized in Section 2 and 3 above upon presentation of the proper voucher or vouchers.

 

SECTION 6. That various adjustments and line item expenditures and transfers are authorized to comply with agreements and contracts authorized in Section 2 and 3 above.

 

SECTION 7. That the disappropriation of any remaining budget to fund balance is authorized at project closeout.

 

                     SECTION 8. That this Ordinance is declared to be an emergency measure and shall take effect and be in force from and after its passage. The reason for the emergency lies in the fact that this Ordinance is necessary for the immediate preservation of the public peace, health, safety and property, and for the further reason that this Ordinance must be immediately effective in order to maintain the operational integrity of the Water Reclamation Plant, and to maintain compliance with the NPDES discharge permit requirements, as set forth by the Ohio EPA.
