SUMMARY & BACKGROUND:
City of Toledo Fire and Rescue personnel performing training drills using the University of Toledo's Scott Park facility on June 17, 2020, caused the University's Scott Park water main to break, for which the City of Toledo was billed $12,714.73 for the total cost to repair the water main.
Summary
NOW, THEREFORE, Be it ordained by the Council of the City of Toledo:
SECTION 1. That the payment of $12,714.73 in settlement of the claim of University of Toledo is approved.
SECTION 2. That the payment of this claim is contingent upon the execution of the proper release by University of Toledo.
SECTION 3. That an expenditure in the amount of $12,714.73 is authorized from the Risk Management Fund, Account Code 7095-12000-1157001STDSTD, for settlement of the claim from the University of Toledo.
SECTION 4. That the Director of Finance is authorized to draw warrant or warrants to the University of Toledo in the sum of $12,714.73 against the account code listed in Section 3 upon presentation of the proper voucher or vouchers.
SECTION 5. That this Ordinance, being an emergency measure, shall be in force and effect from and after its passage. The reason for the emergency lies in the fact that this Ordinance is necessary for the immediate preservation of the public peace, health, safety and property, and for the further reason that this Ordinance must be immediately effective in order to implement the settlement in accordance with the conditional agreement of the Administration.
