SUMMARY & BACKGROUND:
A significant number of residents of the City of Toledo are mobility impaired. Many of these individuals reside in areas where parking, both on-street and off-street is limited. On October 24, 1989 the City of Toledo City Council passed Resolution 233-89 establishing a policy pertaining to special parking zones for individuals with mobility impairments in residential areas in the City of Toledo.
It is desirable and necessary to revise the policy governing the special reserved parking spaces for individuals with mobility impairments so the policy may be implemented in a fair and equitable manner consistent with the current standards and practices. Representatives from the City of Toledo and The Ability Center have redefined a fair and equitable policy for establishing these special reserved parking spaces.
Summary
NOW, THEREFORE, Be it resolved by the Council of the City of Toledo:
SECTION 1. That the following shall pertain to revision of the policy pertaining to special reserved parking spaces for individuals with mobility impairments in residential areas:
A. Policy
The City of Toledo Department of Public Service/Division of Transportation shall establish a policy regarding special reserved on-street parking spaces in residential areas for vehicles used by or for individuals with mobility impairments, as defined by O.R.C 4503.44(A), only if the below-listed eligibility criteria (subsection B) and application process (subsection C) are met by the applicant. Subsections D, E and F of this resolution are also integral parts of the city’s special reserved parking program for individuals with mobility impairments.
B. Eligibility
1. On-street parking is currently permitted adjacent to the applicant’s residence
2. The applicant possesses a current license tag with the accessibility symbol or a properly authorized and valid BMV-issued disability placard
3. No usable or accessible off-street parking (driveway, parking pad, garage) is available at the applicant’s residence
4. On-site investigation by the Division of Transportation reveals extensive use of on-street parking by the residents and visitors of the street
5. The applicant must be the permanent resident or tenant of the residence for which the request for a special reserved parking space is being made
6. A vehicle that will be using the special reserved parking space must be registered to the address adjacent to the space is being requested
7. On-street parking will not endanger the safety of persons or property; and will not unreasonably interfere with pedestrian or vehicular traffic, or otherwise violate applicable local, state or federal laws regulating public rights-of-way
C. Application Process
Applications for the establishment of a special reserved on-street parking space under this policy shall be requested on forms supplied by the Division of Transportation. All applications shall be forwarded to the Division of Transportation for review. If approved, the applicant will be informed in writing. Approved permits must be reviewed and renewed annually.
If disapproved, the applicant shall have 30 days to submit a written appeal to the Accessible Parking Appeals Panel, in care of the Division of Transportation. The decision of the Accessible Parking Appeals Panel shall be final.
D. Application Form and Program Overview
The Division of Transportation shall provide an application form, program overview, and frequently asked questions to all individuals who express an interest in participating in the program; and also develop and post program information on the city’s Website. Applicants must comply with all rules and regulations implementing the special reserved on-street parking program.
E. Accessible Parking Appeals Panel
The Accessible Parking Appeals Panel shall consist of a representative of The Ability Center, the City of Toledo Law Department, the City of Toledo Office of Diversity & Inclusion, the City of Toledo Department of Public Service, and the City of Toledo Division of Transportation. Members of the Accessible Parking Appeals Panel may appoint an alternate or alternates to represent them on the panel.
F. Procedures Governing Residential On-Street Parking for Individuals with Mobility Impairments
The Commissioner of the Division of Transportation shall be empowered to establish the amount of application and renewal fees and the rules and regulations governing the administration of the program for special reserved parking spaces for individuals with mobility impairments, subject to approval by the Accessible Parking Appeals Panel.
SECTION 2. That this Resolution is declared to be an emergency measure and shall be
in full force and effect from and after its passage. The reason for the emergency lies in the fact that it is necessary for the immediate preservation of the public peace, health, safety, and property and for the further reason that the Resolution must be immediately effective in order to revise the policy governing the residential on-street parking for the mobility-impaired individuals program.
