SUMMARY & BACKGROUND:

Resolution No. 72-20 was adopted by City Council on February 25, 2020. It was determined lighting on Hill Avenue’s western-most city limit to Byrne Road could be enhanced for the safety of citizens through improved street lighting.  Light Emitting Diode (LED) street lamps offer brighter lighting patterns at a lower cost due to less energy consumption.  Increasing light intensity on various streets and intersections by replacing the current streetlights with LED streetlights will reduce dangerous intersections and increase public safety in general. The total cost for the installation of the lighting is $25,920 and the annual operation and maintenance costs of the lighting is $20,156.42 of which the city’s share is $1,322.04.

Summary

NOW, THEREFORE, Be it ordained by the Council of the City of Toledo:

 

                     SECTION 1.                     That it is determined to proceed with the improvement of the following lots and lands by installing street lighting, as described below, pursuant to the authority cited below and in accordance with Resolution No. 72-20, adopted on February 25, 2020, and in accordance with plans, specifications, and estimates heretofore approved and on file with the Clerk of Council and in the Department of Public Service.

 

A.                     Hill Avenue between the city’s western-most city limit to Byrne Road by installing thirty-four (34) 260-watt LED cobra head fixtures and replacing thirty (30) current cobra head fixtures with 260-watt LED lights.

                     

                     SECTION 2.                     That an expenditure in the amount of $24,714 is authorized from the Special Assessment Fund, Account Code 3050-11200-2424004STDSTD and an expenditure in the amount of $1,206 from the General Fund, Account Code 1001-11200-2424004STDSTD for the installation of LED lighting at the location listed in Section 1 for a total cost of $25,920.

 

                     SECTION 3.                     The following lots and lands are determined to be specifically benefitted by said improvement and each shall be assessed at the estimated rate per assessed front foot indicated, representing that part of the cost of lighting said streets as above described:

 

A.                                          All lots and lands bounding and abutting the section Hill Avenue’s western-most city limit to Byrne Road are assessed at the rate of ($0.841) per assessed front foot.

 

SECTION 4.                      That the estimated annual operation and maintenance costs of the lighting is $20,156.42 of which the city’s share is $1,322.04.

 

                     SECTION 5.                     That the costs related to this improvement shall be levied and assessed annually in accordance with the ordinance to levy hereafter to be passed by the Council, and shall be certified to the County Auditor to be placed upon the tax duplicate and collected as other taxes.

 

                     SECTION 6.                     That the remainder of the cost and expense of said improvement not specially assessed together with damages, if any, awarded to the owner or owners of adjoining lands with interest thereon, and the costs and expenses of any such award shall be paid by a levy upon the general tax list made by the city for such purpose in the manner provided by law.

 

                     SECTION 7.                     That the Toledo Edison Company is authorized and directed to accomplish the improvements described in Section 1 hereof; such lights to be erected and maintained, and payment therefore to be made in accordance with the applicable terms and provisions of the Toledo Edison street lighting tariff as approved by the Public Utilities Commission of Ohio.

 

                     SECTION 8.                     That the Clerk of Council  is directed to furnish Toledo Edison Company with a certified copy and written notice of the passage of the Ordinance after publication of the same.

 

                     SECTION 7.                     That this Ordinance is declared to be an emergency measure and shall be in force and effect from and after its passage.  The reason for the emergency lies in the fact that the same is necessary for the immediate preservation of the public peace, health, safety, and property and for the further reason that this Ordinance must be immediately effective in order to expedite the installation of street lighting.
