SUMMARY & BACKGROUND:

The World Health Organization (WHO) has declared the COVID-19 outbreak a pandemic. The Federal Government has declared a national emergency. The State of Ohio has declared a state of emergency in response. The Governor and the Director of the Board of Health have ordered a ban on all mass gathers of 100 people (indoor and outdoor) in the State of Ohio.

 

\In light of the recommendations of the State of Ohio’s Governor and the Ohio Department of Health, the City is preparing for increasing remote work for its employees to maintain the operations of the City uninterrupted.

 

Purchase of hardware and services to implement the increased need for remote work connections was undertaken on March 12, 2020.  Per protocol, TMC 187 requires Council to be informed of the emergency and for authorization to pay the contract.  At the time of the emergency purchase, sufficient unencumbered funds were available within the Information and Communication Technology Department budget. This ordinance authorizes the appropriation of Capital Improvement (CIP) funds and a transfer of expenditure from the Information & Communications Technology Fund to CIP. This will ensure the ICT budget is not affected by this emergency purchase.

 

Summary

NOW, THEREFORE,                      Be it ordained by the Council of the City of Toledo:

 

SECTION 1.  That the contract entered into by the Mayor for the emergency purchase of hardware and implementation services to increase employee remote ICT network connections be, and is hereby ratified.

 

SECTION 2.   That the amount of $70,000 is authorized for expenditure from the Information & Communications Technology Fund, account code 7084-17500-1144006HWMAIN for payment of the emergency contract ratified in Section 1 hereof. 

 

SECTION 3.  That the amount of $70,000 is appropriated from unappropriated balance of the Capital Improvement Fund to account code 5040-17500-8CP2045ICTHDW for hardware and implementation services for remote ICT network connections and the transfer of the expenditure authorized in Section 2 is authorized from the Information & Communications Technology Fund to the Capital Improvement Fund.

 

SECTION 4.                     That the Director of Finance is authorized to issue his warrant or warrants against the account code identified in Section 2 in the amount not to exceed $70,000 in payment of the obligations incurred pursuant to the emergency contract ratified in Section 1 upon presentation of proper voucher or vouchers.

 

SECTION 5.  That this Council finds that it is in the best interest of the City that the competitive bidding requirements of TMC Chapter 187 were waived for the reason that the immediate procurement of the hardware and implementation services were necessary to avoid an interruption of City services considering the COVID-19 pandemic.

 

SECTION 6.   That this ordinance be declared to be an emergency measure and shall be in full force and effect after its passage. The reason for the emergency lies in the fact that this ordinance is necessary for the immediate preservation of the public peace, health, safety and property and for the further reason that this ordinance must be immediately effective in order to facilitate the expeditious payment of hardware and implementation services for increased remote connection services.
